Activity:
To operate and maintain an existing 0.12 MGD combined sewer collection and treatment system serving the Town of Davis and its environs including Tuscan Ridge Development, and discharging treated wastewater via Outlet No. 001 to the Blackwater River (approximately 10.7 miles from its mouth) of the Black Fork River. To operate and maintain disposal systems, best management practices, and the nine (9) minimum controls for the direct discharge of sanitary wastewater and storm water from Combined Sewer Overflow Outlet Nos. C003 and C004 to the Blackwater River; and Combined Sewer Overflow Outlet No. C005 to Beaver Creek of the Blackwater River. These CSO outlets are permitted to discharge only when the hydraulic capacity of the combined collection system is exceeded during wet weather events. An antidegradation review has been conducted and Tier 1 protection is provided for the uses specified in Title 47, Series 2, Section 6 for the discharge from Outlet No. 001. Tier 1 protection shall be provided for the discharges from the CSO outlets through implementation of the facility’s Long-Term Control Plan.

Compliance shall be attained in accordance with Administrative Order No. 5830 and any amendments thereto.
On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.
Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:

The public comment period begins June 15, 2016 and ends July 15, 2016.
Comments received within this period will be considered prior to acting on the permit application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s). Interested persons may contact the public information office to obtain further information.
The application draft permit and any required fact sheet may be inspected, by appointment, at the Division of Water and Waste Management Public Information Office, at 601 57th Street SE, Charleston, WV 25304-2345, between 8:00 a.m. and 4:00 p.m. on business days. Copies of the documents may be obtained from the Division at a nominal cost. Calls must be made 8:30 a.m. to 4:30 p.m. Monday through Friday.
