The object of the above entitled civil action is to recover damages and compensation for damages suffered by the Plaintiff;s insured in an accident involving said insured and Zachary Williams. Plaintiff is seeking subrogation from Defendants for claims paid to the its insured. Cross-complainant, Timothy McDonald, has filed a cross-claim against Zachary D. Williams for contribution and indemnification.
It appearing that an affidavit filed in this action that the location and whereabouts of Defendant, Zachary D. Williams, cannot be ascertained through due diligence, it is hereby
ORDERED that he do appear and serve upon Kevin T. Tipton, counsel for Cross-Complainant, Timothy McDonald, whose address is 316 Merchant Street, Suite 100, Fairmont, WV 26554, an answer or other defense to the cross complaint filed in this action or or before June 18, 2015, otherwise judgment by default will be taken against him as any time thereafter.
A copy of said complaint can be obtained from the undersigned Clerk at his office located in Elkins, in said county and state.
