Legal Notice Charter’s (formerly Time Warner Cable) agreements with programmers and broadcasters to carry their services and stations routinely expire from time to time. We are usually able to obtain renewals or extensions of such agreements, but in order to comply with applicable regulations, we must inform you when an agreement is about to expire. The following agreements are due to expire soon, and we may be required to cease carriage of one or more of these services/stations in the near future: Youtoo, Pivot, ShopHQ/EVINE Live, POP/TVGN, Music Choice (channels 901-950), Outdoor Channel, Weather Channel, FM. In addition, from time to time we make certain changes in the services that we offer in order to better serve our customers. The following changes are planned: On or about August 12th, the POP scrolling guide on Standard TV channel 15 will no longer be available. The undersigned Trustees, by virtue of the authority vested in them by that certain deed of trust dated February 16, 2007, and duly recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed of Trust Book 1534, at page 616, Francis J. Travinski did convey unto Stewart Title Insurance Company, Trustee, certain real property described in said deed of trust; and the beneficiary has elected to appoint Terra Abstract Trustee West Virginia Inc. as substitute Trustees by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned deed of trust and the undersigned Trustees, having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Monongalia County Courthouse, 243 High Street, Morgantown, West Virginia 26505 on:

BEGINNING at a 5/8“ iron pin (set) being a common corner to Junior Harold and Wande Leo Shaver and the lands of Cecil and Hazel Casteel, and standing in the western right of way limits of U.S Route #119. the point of beginning; thence leaving the said Route 119, with the line of Shaver and Casteel South 53°36` 36“ West a distance of 338.25 feet to a 1“ pipe (found) being a common corner to Shaver, Costeal James Keyser and the lands of Angolo A. Petrio; thence with three lines of Shaver and Pettito North 36°13` 14“ West a distance of 22.33 feet in a 5/8“ iron pin (set)? thence North 53° 46` 56“ East a distance of 25.00 feet to a 5/8“ iron pin (set)? thence North 53° 46` 56“ East a distance 25.00 feet to a 5/8“ iron pin (set)? thence North 02° 55` 45“ East a distance of 467.20 feet to a 1/2“ bent iron pin (found), being a common corner to Richard and Patricia Adams; thence with the line of Shaver and the lands of Adams, South 80° 25` 09“ East a distance of 170.25 feet to a point, being a common corner to Shaver and the lands of Adams and standing at the western right of way limits of U.S. Route 119; thence with the limits of said Route 119 with a curve to the left having a radius of 1377.74 feet and arc length of 280.70 feet and a chord bearing South 15°14` 12` East for a distance of 200.12 feet to the point of beginning ad containing 1.935 acres, more or less, as shown on
a plat of survey prepared May 20, 2002, by Blue Mountain Engineering.

Together with and conveyed herewith the right to use, in common with Garland E. Long, and Leona M. Long or their successors in title, a certain 18 foot right of way heretofore conveyed to R.C. Lough by deed from Cecil F. Casteel and Hazel Hamer Casteel, husband and wife, Dated the 31st day of October, 1967, of record in said Clerk`s Office in Deed Book No. 667, at page 601

Excepting and Reserving all the coal in and underlying said track or parcel of land, together with the mining rights and privileges appurtenant thereto, said coal mining rights having been heretofore sold and conveyed.

Being the same property conveyed unto Francis J. Travinski by Deed dated August 5, 2004, filed for record on August 18, 2004 in the office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed
Book 1278, at page 213. Also being the same property conveyed unto Junior Harold Shaver and Wanda Lee Shaver by deed dated June 17, 2002 and of record in the aforesaid Clerk`s office in OR Volume 1234, at page 54.

This conveyance is made subject to all exceptions, reservations, restrictions, rights of way, easements, covenants and conditions as set forth and contained in prior Deeds or other instruments in the Grantor`s chain of title to said real estate.

The aforesaid property is SUBJECT TO any and all easements, rights-of-way, conditions, covenants and restrictions of record or in existence.

The sale of the foregoing real property will be made subject to all exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record, if any, pertaining to said real estate, subject to all matters disclosed by an examination and inspection of the property, subject to any and all unpaid taxes as recorded against said property, and to any further matters announced at said sale. The property is sold subject to an accurate survey at purchaser’s expense.

The sale of the foregoing real property will also be made expressly subject to any and all other deeds of trust, judgments, liens, and all other encumbrances of any nature whatsoever, if any, having priority over the deed of trust referred to herein.

The Trustees reserve the right to adjourn the sale, for a time, or from time to time, without further notice, by announcement at the time and place of sale describe above or any adjournment thereof. The Trustees reserve the right to reject any and all bids.

The subject property will be sold in "AS IS" condition. The Trustees shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. The Trustees will deliver a trustees’ deed to the purchaser without any covenant or warranty (express or implied) in the form prescribed by W. Va. Code ยง38-1-6. The Trustees make no representations and warranties about the title of the real estate to be conveyed. If the Trustees are unable to convey insurable or marketable title to purchaser for any reason, purchaser’s sole remedy is return of deposit.

TERMS OF SALE: $9,000.00 cash in hand at the time of sale in the form of a certified check or cashier’s check made payable to "Terra Abstract Trustee West Virginia Inc.," and the balance in cash closing within 30 days of the date of the sale. Purchaser shall pay for transfer stamps and recording fees. Additional terms of sale may be announced prior to the sale.
