NOTICE OF PUBLIC HEARING ON BOUNDARY LINE ADJUSTMENT The Town Council of the Town of Cedar Bluff, Virginia will hold a public hearing on a proposed Boundary Line Adjustment Agreement between the County of Tazewell and the Town of Cedar Bluff (the “Agreement”), in council chambers at the Cedar Bluff Town Hall, 115 Central Avenue, Cedar Bluff, Virginia 24609, on Tuesday, September 13, 2016, at 7:30 p.m. Immediately following the public hearing the Town Council at its regularly-scheduled meeting intends to adopt a resolution to approve the Agreement and submit it to the County of Tazewell for public hearing, consideration, and approval by its Board of Supervisors. The Agreement is authorized by Section 15.2-3106, et seq., of the Code of Virginia (1950), as amended, and provides that the boundary line between the County and the Town will be relocated by incorporating into the Town of Cedar Bluff certain territory which is presently located within the unincorporated portions of the County. A survey plat attached to the Agreement depicts the new boundary line between the Town and the County in the area where the boundary line would be changed by the Agreement, and is available or inspection at the Cedar Bluff Town Hall during weekdays between 8:00 a.m. and 4:30 p.m. The territory that would be incorporated within the Town consists of an area containing 292.856 acres of land (the “Area”) and lies generally to the east of the current Town limits. The new boundary line of the Town would generally include area on both sides of Secondary Route 631 and the community commonly known as Bane Bottom. The boundaries of the Area are fully described by metes and bounds in the Agreement, and as published hereafter in this notice. The proposed Agreement provides that the County of Tazewell and the Town of Cedar Bluff, after approving the Agreement, shall promptly petition the Circuit Court of Tazewell County jointly to relocate and establish the boundary line as agreed upon, and that the new boundary line shall become effective at midnight on December 31, 2016, unless otherwise agreed to by the two of them, and that in the event that a final court order has not been entered by that date, the new boundary line shall become effective at midnight on February 28, 2017 or at midnight on the 31st day following entry of a final order, whichever date occurs last. The cost of the proceeding will be paid by the Town. Any person interested in the Agreement may appear at the public hearing and present his or views. The Area is described as follows: Beginning at a point on top of a ridge, said point being a corner of the existing corporate boundary of the said Town of Cedar Bluff (said corner witnessed by a metal fence post at N 01? 51′ 46″ W, 11.23 feet and a snag in a fence line at N 72? 17′ 58″ E, 25.45 feet); thence leaving said existing corporate boundary with four (4) new lines of the new corporate boundary of said Town of Cedar Bluff S 65? 23′ 05″ E, 3577.27 feet to a rod set west of a public road; thence S 52? 36′ 33″ E (crossing said public road and passing a rod set north of Route 631 at 1399.40 feet), 1478.57 feet crossing said Route 631 to a post south of said Route 631; thence, S 40? 17′ 50″ E (crossing a creek), 494.07 feet to a rod set; thence S 47? 18′ 22″ W, 4766.93 feet to an 18″ chestnut oak on the said existing corporate boundary of said Town of Cedar Bluff; thence leaving said new coprorate boundary of said Town of Cedar Bluff with seven (7) lines of said existing corporate boundary of said Town of Cedar Bluff N 10? 16″ 50″ E, 382.95 feet to a 36″ cherry (Called for)’ thence N 65? 27″ 11″ W, 133.89 feet to a post (called for); thence N 09? 58′ 18″ W, 1804.96 feet to an 8″ maple (called for)’ thence N 06? 46′ 38″ W (crossing Route 631 and the N & W Railroad), 1470.36 feet to a 12″ red oak (called for); thence N 04? 34′ 18″ E, 226.79 feet to an 18″ white oak (called for); thence N 04? 22′ 04″ W, 221.70 feet to an 8″ chestnut oak (called for)’ thence N 20? 32′ 45″ W, 2007.43 feet to the beginning.
