NOTICE OF TRUSTEE SALE Pursuant to the authority vested in the undersigned by Deed of Trust dated the 28th day of October, 2009, executed by Cherilyn D. Thomas and Elwin Thomas, Jr., unto Mike Day and Harold B. Wolfe, III, Substitute Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1177 at Page 552, and the undersigned, Harold B. Wolfe, III, have been requested to do so by the beneficiary, and default having been made under the terms and conditions of said Deed of Trust, and the provision in said Deed of Trust concerning acceleration having been compiled with by the beneficiary and present holder ofthe Note, said Trustee will sell at public auction at 10:00 a.m. on the 5th day of January, 2017, at the front doors ofthe Courthouse ofMercer County, West Virginia, the following described property, to-wit: “All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate and being in the City ofBluefield, Mercer County, West Virginia, and designated on the map of said City as Lot 5, Section 420, being more particularly bounded and described as follows: BEGINNING at a point on the westerly line of the Bluefield-Bramwell Macadam Road at the southeast comer of Lot 4 (which point of beginning is 206.17 feet from the south line ofa 30 foot wide street known as Harry Avenue); thence from said beginning point and with the southeasterly line ofLot 4, S. 40? 00′ W. 163.7 feet to a line ofHarry Avenue; thence with same, S. 46? 07′ E. 52.2 feet; thence N.40? 00′ E. 167.3 feet to said Macadam road; thence with same, N. 50? 00′ W. 52.17 feet to the point of BEGINNING.” And being the same property conveyed unto Elwin Thomas, Jr., and Cherilyn Thomas from Donald Kevin Hendrick and Beverly H. Calhoun, by deed dated the 12th day of October, 2009, of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 943 at Page 230. It is the intention ofthis Notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid Deed of Trust. The above described real estate is reported to have a physical address at 699 Old Bramwell Road, Bluefield, Mercer County, West Virginia, 24701. This sale will also be made subject to any and easements heretofore granted by predecessors in title; and subject further to any and all unpaid real property taxes and unpaid assessments, the purchaser assuming payment thereof. The owners and holders ofsaid Note reserving the right to enter a bid at said sale and the right to reject any and all bids. The Trustee reserves the right to reject any and all bids. TERMS OF SALE: Cash in hand on the day of sale, or upon terms to be agreed upon between Trustee and successful bidder; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title to this property.Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a Notice of same where legal notices are posted for this county.
