NOTICE OF SUCCESSOR TRUSTEE’ S SALE

Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, James W. Lane, Jr. and Bradford P. Bury, by that certain Deed of Trust made by Richard S. Michael, dated February 26, 2010 and recorded March 24, 2010 in the office of the Clerk of the County Commission of Monongalia County, West Virginia in Trust Deed Book 1740 at page 512, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated July 20, 2017 and recorded August 21, 2017 in the aforesaid Clerk’ s office in Substitute Trustee Book 2199, at page 383, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Monongalia County, West Virginia, on October 18, 2017 at 10:00 a.m., all that certain lot, piece or parcel of real property, together with improvements thereon, situate in Monongalia County, West Virginia, being more particularly bounded and described as follows:

All of that certain lot, parcel, or tract of real property, together with the improvements thereon and the appurtenances thereto, located and situate in the Fifth Ward of the City of Morgantown, Morgan District, Monongalia County, West Virginia, which is more particularly described as follows:

All of Lots Nos. 1 and 2 in Block 3 of the Valley View Addition as shown on a plat of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book No. 196, at Page 350, more particularly described as follows: Beginning at a ½ inch iron pin set on the southern right of way limits of Richwood Avenue, corner to Anna Mills and Lot No. 1; thence with the southern right of way limits of Richwood Avenue, N. 50°15’ E. 87.30 feet to a ½ inch iron pin set, corner to Lots Nos. 2 and 3; thence with one line of Lot No. 3, S.39° 45’ E. 100.00 feet to a ½ inch iron pin set on the northern right of way limits of a 15 foot alley, corner to Lots Nos. 2 and 3; thence with the northern right of way limits of said 15 foot alley, S.50° 15’ W. 92.98 feet to a ½ inch pin set in line of Anna Mills, corner to Lot No. 1; thence with one line of Anna Mills N. 36°29’ 57” W. 100.16 feet to the place of beginning, containing 9,014.00 square feet, more or less.

There is further granted and conveyed all rights, interest, estates and obligations arising under and created by that letter agreement dated January 9, 2004, from the City of Morgantown, and which is of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, at Deed Book 1301, page 34.

This property was conveyed unto Richard S. Michael from Thomas M. White and Mary Ann White, husband and wife, by deed dated July 25, 2005, and recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book 1301, at page 33.

At the time of execution of the deed of trust, the grantor represented that the address of the property was 850 Richwood Avenue, Morgantown, WV 06505.

TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The Premises will be conveyed by deed with no covenants of warranty of title. The Premises shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The Premises shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’ s office or visible upon the ground. The Premises will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and United Bank, Inc. shall not be responsible for the removal of any person or personal property from the Premises.

Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the Premises at such sale.
