NOTICE OF TRUSTEE’S FORECLOSURE SALE ON VALUABLE RESIDENTIAL REAL ESTATE Notice is hereby given that by virtue of that certain Deed of Trust dated March 26, 2010, from William D. Tilson, to Mike Day and Harold B. Wolfe, III, Trustees, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1185, at page 644, the Note therein secured being in default, and the undersigned having been appointed Substitute Trustee, pursuant to a Substitution of Trustee dated July 15, 2014, and of record in said Clerk’s Office in Trust Deed Book 1281, at page 243, the undersigned Substitute Trustee and Trustee, at the request of the Note holder, will offer for sale and sell at public auction on JANUARY 16, 2015, at 9:30 o’clock a.m. at the Front Door of the Mercer County Courthouse (being the North Walker side), at Princeton, Mercer County, West Virginia, the following described real estate, to-wit: “All that certain lot or parcel of real estate situate in the City of Bluefield, Mercer County, West Virginia, being a lot on the north side of Augusta Street, fronting 100 feet thereon and running back 200 feet, and being unnumbered on the Map of said City”, and more particularly bounded and described as follows: “BEGINNING at a point on said north line of Augusta Street directly opposite the east line of Walton Avenue and being the southeast corner of Lot 11, Section 1012, and being the southeast corner of the old Calfee line; thence from said beginning point and with the east line of said Lot 11, Section 1012, N. 17? 06′ W. 200 feet; thence N. 60? 23′ E. 100 feet; thence S. 17? 06′ E. 200 feet to said line of Augusta Street; thence with same, S. 60? 23′ W. 100 feet to the point of BEGINNING.” At the time of the execution of the Deed of Trust, this property was reported to have an address of 1118 Augusta Street, Bluefield, West Virginia 24701. The above-referenced real estate will be conveyed with no covenants of warranty and subject to all leases, covenants, restrictions, easements, rights-of-way, and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances including, without limitation, liens for real estate taxes, sanitary and sewer charges. IN THE EVENT THERE ARE FEDERAL TAX LIENS AGAINST THE PROPERTY, THE UNITED STATES WOULD HAVE THE RIGHT TO REDEEM THE PROPERTY WITHIN 120 DAYS FROM THE DATE OF SUCH SALE OR THE PERIOD ALLOWABLE FOR REDEMPTION UNDER LOCAL LAW, WHICHEVER IS LONGER. The terms of the Sale shall be cash in hand on the day of sale (or such other arrangement as may be satisfactory to Trustee and holder of the Note). Said real estate will be sold by said Trustee in “AS IS” condition, subject to all taxes now due or to become due on said property, all liens, out conveyances, matters of survey, compliance with environmental regulations, rights of tenants in possession, if any, and other matters of record in said Clerk’s Office affecting the title to said property. The purchaser is to pay the excise tax on the privilege of transferring said real estate. The Trustee reserves the right to continue the Sale or to adjourn same for a time, or from time to time, without further Notice by announcement at the time and place of said Sale hereinabove set forth. THE PURCHASER, UPON PAYMENT OF THE PURCHASE PRICE IN FULL, SHALL RECEIVE FROM THE HEREINABOVE NAMED TRUSTEE, A DEED CONVEYING THE HEREINABOVE DESCRIBED PROPERTY, WITHOUT ANY COVENANT OR WARRANTY, EITHER EXPRESS OR IMPLIED, AND SUBJECT TO THE MATTERS HEREINABOVE MENTIONED. Notice is also given that any personal property and/or belongings remaining at the property afer the Foreclosure Sale will be deemed to constitute abandoned property and will be disposed of accordingly.
