X341-125-0.02 00, DE-0062(824)T PARCEL NO. 99-1 WEST VIRGINIA DEPARTMENT OF TRANSPORTATION, DIVISION OF HIGHWAYS, Petitioner v. WELDON E. DAVIS, et al., Respondents. NOTICE OF PUBLICATION To the Above-Named Respondent and other lawful claimants: The object of the above proceeding is to condemn certain property of the Respondent, or in which the Respondent has an interest, for public purposes for a right of way for constructing, widening, straightening, grading, altering and otherwise improving a certain public road in Richmond District, Raleigh County, West Virginia, known as Project No. X341-125-0.02 00, DE-0062(824)T, the property proposed to be condemned being a part of Parcel No. 99-1 of the Project, as designated on the Plans and Profile of the project filed in the Office of the Clerk of the County Commission of Raleigh County, West Virginia. The property to be condemned for the purpose aforesaid is more particularly described as follows: NONCONTROLLED ACCESS RIGHT OF WAY: Beginning at a point in the western existing right of way line of Raleigh County Route 26, said point being in the division line between West Virginia Department of Transportation, Division of Highways, and Felicia Rae Davis Smith and Weldon Edward Davis and 12 feet radially left of proposed WV Route 125 centerline at Station A 1325+14, Project X341-125-0.0200, DE-0062(8240T, Summers and Raleigh Counties, West Virginia; Thence, southwesterly with said division line 25 feet, more or less, to a point in the western proposed noncontrolled access right of way line of proposed WV Route 125, said point being 36 feet radially left of centerline at Station A 1325+14; Thence, northwesterly with said proposed noncontrolled access right of way line 80 feet, more or less, to a point 30 feet radially left of centerline at Station A 1325+95; Thence, northwesterly continuing with said proposed noncontrolled access right of way line 60 feet, more or less, to a point in the division line between United States Department of the Interior, National Park Service, and Felicia Rae Davis Smith and Weldon Edward Davis, said point being 34 feet radially left of centerline at Station A 1326+55; Thence northeasterly with said division line 23 feet, more or less, to a point in the western existing right of way line, said point being 12 feet radially left of centerline at Station A 1326+54; Thence, southeasterly meandering with said existing right of way line 140 feet, more or less, to the place of beginning and containing 3,015 square feet, more or less. The above-named Respondent is hereby notified: 1. That the above-styled condemnation proceeding was instituted in the Circuit Court of Raleigh County on or about November 15, 2016, to take and appropriate the above described property for the purposes aforesaid; 2. That you may serve upon Stephen C. Gregory, Esq., West Virginia Division of Highways, 1900 Kanawha Boulevard East, Building 5, Room A-517, Charleston, West Virginia, 25305, an answer to the Petition filed herein; 3. That a copy of the Petition may be obtained from the Clerk of the Circuit Court of Raleigh County; 4. That hearings to determine the right of the Petitioner to take, appropriate and use the above-described land will be held; 5. That Land Commissioners may be selected, whose purpose will be to determine just compensation for the land proposed to be taken and for damages, if any, to the residue, and 6. That any and all other proceedings may be held and had as may be proper, at which time and place you, and each of you, are hereby notified to be present to protect your interests in said proceeding.
