NOTICE OF SUBSTITUTE TRUSTEE’S SALE
Notice is hereby given that by virtue of that certain Deed of Trust dated March 11, 2009, executed by Mary B. Fleshman, to William D. Goodwin, Trustee, said Deed of Trust being of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Trust Deed Book 647 at Page 387, the makers of the Note and obligation secured thereby having failed to pay the same as provided for under the terms of said Note and Deed of Trust, and default not cured within the terms of said note and Deed of Trust, the holder of the Note having declared the whole thereof to be due and payable and having requested the undersigned, in writing, to make sale of the real estate described in said Deed of Trust, I will sell at public auction to the highest bidder on January 9, 2017, at 10:00 a.m. of that day at the front door of the Courthouse of Greenbrier County, 200 North Court Street, Lewisburg, West Virginia, the following described real estate, to-wit:
All that certain lot, tract or parcel of land, together with the buildings thereon, and the easements, rights of way and appurtenances thereunto belonging, situate in Meadow Bluff District, Greenbrier County, West Virginia, lying approximately 1500.00 feet S.E. of the intersection of S.L.S. 24 and S.L.S. 29, on the waters of Meadow River, and being more particularly described as follows:
BEGINNING at a point in the south west right-of-way line of S.L.S. #29 as reference set a ½ inch iron rod reference corner S 63 degrees 60 minutes 28 second W at 5.00 feet, from which a line bears S 68 degrees 52 minutes 00 seconds E 9.43 feet to the end of a 28 inches culvert, and a line bears S 14 degrees 45 minutes 00 seconds E 85.63 feet to an A.P.C.O., pole #73904, thence with said right-of-way line; S 32 degrees 24 minutes 44 seconds E 277.65 feet, to a ½inch iron pipe, set, thence leaving said right-of-way and through the Martin 230 acre tract, of which this is part of; S 63 degrees 32 minutes 23 seconds W 180.91 feet, to a ½ inch iron rod, set thence; N 32 degrees 12 minutes 52 seconds E at 174.93 feet crossing reference corner in all 179.73 feet, to the place of BEGINNING and CONTAINING 1.14 ACRES MORE OR LESS AS SURVEYED BY BRACKENRICH & ASSOCIATES INCORPORATED IN MAY, 1985.
This property is being auctioned by Jeffry A. Pritt, Pritt Law Firm, PLLC, pursuant to his appointment as Substitute Trustee by that certain Substitution of Trustee, dated the November 18, 2016, of record in the aforesaid Clerk’s Office in Trust Deed Book 771 at Page 155.
This property is being sold subject to the conditions, covenants, restrictions, leases and other servitudes of record, if any, pertaining to said real estate, subject to all matters disclosed by an examination and inspection of the property, subject to any and all unpaid taxes as recorded against said property, and subject to any further matters at said sale.
The Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment thereof.  The Trustee reserves the right to reject any and all bids.
The subject property will be sold in “as is” condition.  The Trustee shall be under no duty to cause an existing tenant or person occupying the subject property to vacate said property. The Trustee will deliver a Trustee’s Deed to the purchaser without any covenant or warranty (express or implied) in the form prescribed by WV Code § 38-1-6.  The Trustee makes no representationor warranties regarding the title of the real estate to be conveyed.  If the Trustee is unable to convey insurable or marketable title to purchaser for any reason, purchaser’s sole remedy is a return of the required deposit.
TERMS OF SALE:  $ 5,000.00 cash in hand on the day of sale in the form of a certified check or cashier’s check made payable to Pritt Law Firm, PLLC, with the balance of the purchase price to be paid in cash at closing within 30 days of the date of the sale. Purchaser shall be responsible for any unpaid property taxes.  Further, Purchaser shall pay for transfer stamps and recording fees.  Additional terms of sale may be announced prior to sale.
