NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, James W. Lane, Jr. and Bradford P. Bury, by that certain Deed of Trust made by Limer Properties, LLC, dated April 23, 2015 and recorded May 5, 2015 in the office of the Clerk of the County Commission of Raleigh County, West Virginia in Trust Deed Book 5054 at page 6117, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated November 15, 2016 and recorded November 21, 2016 in the aforesaid Clerk’s office in Trust Deed Book 5063, at page 8432, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Raleigh County, West Virginia, on January 11, 2017 at 10:00 a.m., all that certain lot, piece or parcel of real property, together with improvements thereon, situate in Beckley, City of Beckley District, Raleigh County, West Virginia, being more particularly bounded and described as follows: That certain real estate, together with the improvements thereon and appurtenances thereunto belonging, located in the City of Beckley District, Raleigh County, West Virginia, and being a tract of land containing 7,500 square feet, more or less, more particularly described as follows: BEGINNING at a point in the east line of Woodlawn Avenue where the northwest line of Earwood Street runs to said point; thence with the line of said Earwood Street, N 65 42′ E. 114.68 feet to a point in said northwest line of said Earwood Street at point where the alley line between J. W. Givens and Burleson connects with said Earwood Street; thence with said alley line N 24 18′ W 79.8 feet to a stake where said alley line connects with the southeast line of a 12 foot alley; thence with said line of said alley, S 53 28′ W 125.20 feet to a point in said west line of Woodlawn Avenue where said alley line connects with said Woodlawn Avenue line; thence with said east line of Woodlawn Avenue, S 32 16′ E 51.65 feet to the BEGINNING, containing 7,500 square feet. And being the same property acquired by Limer Properties, LLC, a West Virginia limited liability company, by deed dated May 24, 2013, from 300N LLC, a West Virginia limited liability company, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5051, at page 7104. There is further conveyed all rights of the Grantor herein to a certain 8 foot alley adjacent to said lot or parcel of land, which said lot or parcel of land and rights in said 8 foot alley were acquired by the Burleston Motor Company from W. H. Rardin, single, by deed dated August 15, 1935, and of record in the Office of the Clerk of the County Court of Raleigh County, West Virginia in Deed Book 128 at page 432 and also; There is further conveyed all right, title and interest of the Grantor herein in and to a certain 2 foot strip adjacent to said 8 foot alley enlarging said alley to a 10 foot alley, which said rights were conveyed to the Burleston Motor Company by deed dated March 11, 1938, recorded August 17, 1953, and of record in the aforesaid Clerk’s Office in Deed Book 328, at page 273. At the time of execution of the deed of trust, the grantor represented that the address of the property was 109 Woodlawn Avenue, Beckley, WV 25801. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The Premises will be conveyed by deed with no covenants of warranty of title. The Premises shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The Premises shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The Premises will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and United Bank, Inc. shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
