NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE Pursuant to the authority vested in the undersigned by deed of trust dated the 31st day of July 2008, signed by Joshua S. Gregory and Kasi A. Gregory aka Kasi A. Morrison, husband and wife, to Louis George, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Trust Deed Book 827, at page 206, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 1:30 o’clock P.M. on the 23rd day of FEBRUARY 2016 at the front doors of the Courthouse in Fayette County in Fayetteville, West Virginia the following described real estate: The following described tract or parcel of surface land, together with any improvements thereon, rights incidental thereto and any appurtenances thereunto belonging, situate in New Haven District, Fayette County, West Virginia, and being more particularly bounded and described as follow, to-wit: BEGINNING at a point, 1/2″ rebar with cap set on a wooded knoll, corner with Tommy and Barbara Carte, as described in Deed Book 546 at Page 15 of which this tract is a portion and corner with Tract #3 of this survey from which a 10″ gum bears S 40 f E 460 feet, thence through the parent tract: S 06 f 43′ E 321.90 feet to a point, 1/2″ rebar with cap set in the outside line of the parent tract, corner with Carte, Alfred McClung and Jay R. Fink; thence with said outside line for one call: N 53 f 32 W 352.57 feet to a point, 1/2″ rebar with cap set on the east side of new Route 60, thence with Route 60 right-of-way for one call N 06 f 14′ W 80.62 feet to a point, 1/2″ rebar with cap set, corner with Tract #3, from which a 6″ maple bears S 74 f W 12 feet, thence with Tract #3, N 83 f 17′ E 256.40 feet to the Point of Beginning, Containing 1.19 acres, more or less, as surveyed by Marathon Technical Services, Inc., in August, 1998, and as shown as Tract #4 on a plat or map for Tommy and Barbara Carte. There is excepted and reserved from this conveyance that certain 20 foot right of way along the western-most line of Tract #4 as shown on the map hereinabove referenced for a more particularly description of the location of said right of way. This deed is made and accepted subject to all validly continuing reservations, restrictions, conditions, covenants, easements and rights of ways made and contained in all prior deeds in the chain of title to the above-described property. Included in this sale is the manufactured home, 1999 Clayton CLR 01540 TNAB. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. The above described real estate is reported to have a mailing address of: Route 60 Spyrock East, Hico, West Virginia 25854 TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees. Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder. Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same.
