NOTICE OF TRUSTEEáS SALE

 

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated December 14, 1999, executed by Borrower(s), Lou Wile and William David Wile, to Wendell Turner and Dennis Broglio, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 873, at Page 52. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of RT 1 Box 229, Williamstown, WV 26187. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 9, 2017, of record in the Clerk’s Office in Book 1995, Page 500. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

 

15th day of January, 2018 at 12:30 p.m.

 

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Williams District, Wood County, West Virginia, and being more particularly described as follows:

 

Situated in the State of WV, County of Wood and in the District of Williams.

 

Being all of Lot No. Three (3) as shown on the plat of the Division of a part of J. H. Sinclair property, Williams District, Wood County, West Virginia, made by Paul Marshall, County Surveyor, September 26, 1958, which said plat is of record in the Office of the Clerk of the County Court of Wood County, West Virginia, in Plat Book No. 11, page 24 to which reference is hereby made and had a for more particular description of said lot.

 

There is excepted and reserved from the above described real estate a right of way or easement for a 2-inch gas line and electric power line, as now located, together with the right of ingress and egress upon said premises, for the purpose of maintenance, repair or replacement of said lines.

 

There is excepted and reserved from the above described real estate the following:

BEGINNING et a point at the intersection of the north line of West Virginia State Route 31 and a public road, said point also being the southeast corner of Lot Number 3 of the said Addition; thence N. 72õ 13á 25ã W. 168.07 feet with the north line of West Virginia State Route 31 to a 1/2ã iron rebar (set); thence N. 13õ 45 01ã E. 21.85 feet to a 1/2ã iron rebar (set); thence N. 76ã 45á 28ã E. 51.30 feet to a 1/2ã iron rebar (set) in a drain; thence N. 17õ 25á 35ã E. 54.17 feet to a 1/2ã iron rebar (set) in drain; thence N. 49õ 59’ 57ã E. 67.76 feet to a 1/2ã iron rebar (set) in a drain; thence S. 73õ 36á 51ã E. 47.29 feet to point in the center of a public road, passing a 1/2ã iron rebar (set) at 37.05 feet; thence S. 16õ 43á 17ãW. 33.58 feet with the center line of the public road to a point; thence S. 00õ 27á 47á 134.02 feet with the center line of the public road to the place of beginning;

containing 0.380 acres, per a survey made by Nelson B. Douglass, on June 16,1999.

 

Also including a right of way for ingress and egress described as follows:

 

BEGINNING at a 1/2 â iron rebar (set) at the southwest corner the above described tract; thence N. 72õ 13’ 25ã W. 20.00 feet to a point; thence N 13õ 45á 01ã E. 21.85 feet to a point; thence S. 72õ 13á 25ã E. 20.00 feet to a 1/2ã iron rebar (set); thence S. 13õ 45á 01ã W. 21.85 feet to the plate of beginning.

 

Being the same property conveyed to Lou Wile and William David Wile by the Deed dated July 16, 1999 and recorded in Deed Book 113 at Page 61 in the Office of the Clerk of the County Commission of Wood County, West Virginia.

 

TERMS OF SALE:

 

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Π11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
