NOTICE OF TRUSTEE’S SALE

 

NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described and the undersigned having been required so to do by the owner and holder of said indebtedness, the undersigned Substitute Trustee {see General Lien Book No. 2004, at page 826 thereof} will offer for sale at the front door of the Wood County Courthouse, Parkersburg, West Virginia, on

 

WEDNESDAY, FEBRUARY 28, 2018, at 10:00 o’clock in the forenoon, local time,

 

at public auction, to the highest bidder for cash, all of the right, title and interest of JOSHUA D. SUTTON in and to the real property described in a certain deed of trust dated April 12, 2010, to RANDALL E. SNIDER and WILLIAM G. POWELL, original Trustees, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in General Lien Book No. 1599, at page 928 thereof, possessed by the said JOSHUA D. SUTTON as at the making of said deed of trust, which said real estate is described in said deed of trust as follows:

 

Situate in the District of Union, County of Wood, and State of West Virginia, more particularly bounded and described as follows:

 

BEGINNING at an iron rod found lying at the Northeasterly corner to that same property as conveyed to Ruby M. Sutton and Joshua D. Waters Sutton of record in Deed Book 1039 at Page 150. said point also being a corner to part of that same property as conveyed to Heartland Forestland Fund, IV of record in Deed Book 1046 at Page 29 (reference Deed Book 485 at Page 128) from which the property to be described below is a part of reference a crosstie corner, found at the Northwesterly corner of above mentioned Sutton at South 75 degrees 35 minutes 33 seconds West 739.08 feet.  THENCE with the Westerly line of said Heartland Forestland Fund, IV North 75 degrees 25 minutes 35 seconds East passing over an iron rod found at 918.27 feet for a total distance of 930.27 feet to a point lying in the center of Pumpkin Knob Road.  THENCE with said road seven calls; South 05 degrees 40 minutes 21 seconds East 181.48 feet to a point South 31 degrees 33 minutes 07 seconds East 214.50 feet to a point South 11 degrees 03 minutes 07 seconds East 231.00 feet to a point South 30 degrees 53 minutes 33 seconds West 150.72 feet to a point South 70 degrees 35 minutes 02 seconds West 264.00 feet to a point South 53 degrees 35 minutes 02 seconds West 412.50 feet to a point and South 79 degrees 56 minutes 20 seconds West 247.92 feet to a common corner to the above mentioned Heartland Forestland Fund, IV and that same property as conveyed to above mentioned Joshua D. Waters Sutton of record in Deed Book 1039 Page 296.  THENCE leaving said road North 11 degrees 19 minutes 01 seconds West passing over an iron rod set at 17.8 feet and an iron rod found at 248.32 feet for a total distance of 878.39 feet to the point of beginning containing a total area 17.62 acres more or less.

 

EXCEPTION: There is excepted and reserved and not conveyed a tract containing 2.00 acres conveyed to Ruby M. Sutton by deed dated the 27th day of April, 2006, of record in the aforesaid Clerk’s Office in Deed Book No. 1096, at page 195.

 

There is further excepted and reserved and not conveyed a tract containing 2.53 acres conveyed to Mark R. Peters and Loretta J. Bell by deed dated the 14th day of September, 2007, of record in the aforesaid Clerk’s Office in Deed Book No. 1119, at page 199.

 

BEING a part of the same real estate conveyed unto Joshua D. Sutton by deed dated the 19th day of April, 2005, of record in the aforesaid Clerk’s Office in Deed Book No. 1081, at page 924.

 

This conveyance is made subject to all rights-of-way, reservations, restrictions, protective covenants, utility easements, and oil and gas leases of record in the chain of title in the aforesaid Clerk’s Office.

 

AND believed to have a street address of 2303 Middle Hill Road, Waverly, West Virginia

 

The following terms will apply to said sale, to-wit:

 

  1. $1,000.00 in cash or certified funds at sale, with balance due within 10 days or as the Trustee and bidder(s) may otherwise agree at sale.

 

  1. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantor and his predecessors in title prior to the granting of the deed of trust being foreclosed upon.

 

  1. The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned.

 

  1. The undersigned reserves the right to reject any and all bids.

 

  1. Sale is subject to unpaid ad valorem taxes and special assessments, if any, as well as any sale of the subject real estate for unpaid taxes.

 

  1. The premises described hereinabove, including any and all improvements thereto, are sold âAS IS-WHERE ISã with no warranty express or implied.

 

  1. The owner and holder of the indebtedness secured by the deed of trust described hereinabove reserves the right to bid at this sale.

 

  1. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed.

 

  1. Neither the owner and holder of the indebtedness secured by the underlying deed of trust nor the substitute trustee shall have any duty to cause any existing tenant or person or persons occupying the subject property to vacate said property.

 

  1. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s or bidders’ discretion. Any person or entity claiming ownership of or any interest in any such property should contact the undersigned prior to sale about any such claim.

 

  1. The successful bidder at the sale and the Trustee shall execute a Memorandum of Sale at the conclusion of the sale, and the terms of the Memorandum shall control.

 

  1. In the event that the successful bidder at the sale fails or refuses to consummate his, her, its or their purchase, then the Trustee shall have the option to consummate sale with the next highest bidder at the sale.
