NOTICE OF TRUSTEE’S SALE

 

NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described and the undersigned having been required so to do by the owner and holder of said indebtedness, the undersigned Substitute Trustee {see General Lien Book No. 1961, at page 100 thereof} will offer for sale at the front door of the Wood County Courthouse, Parkersburg, West Virginia, on

 

Thursday, March 15, 2018, at 10:00 o’clock in the

forenoon, local time,

 

at public auction, to the highest bidder for cash, all of the right, title and interest of MICHAEL R. UMENSETTER in and to the real property described in a certain deed of trust dated November 14, 2007, to RANDALL E. SNIDER and WILLIAM G. POWELL, original Trustees, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in General Lien Book No. 1463, at page 70 thereof, possessed by the said MICHAEL R. UMENSETTER as at the making of said deed of trust, which said real estate is described in said deed of trust as follows:

 

Situate in the City of Parkersburg, County of Wood, and State of West Virginia, more particularly bounded and described as follows:

 

FIRST TRACT: BEGINNING at a point in the north line of Seventh Street 121.88 feet west of the northwest corner of Lynn Street and Seventh Street; thence at right angles to Seventh Street northerly 97 feet, more or less, to the south line of a 15 foot alley at a point therein 122.75 feet west of Lynn Street; thence in a westerly direction toward Swann Street 65.88 feet to a point in the line of said alley; thence at right angles 97 feet, more or less, to the north line of Seventh Street; thence easterly with the line of Seventh Street 65.88 feet to the beginning.

 

SECOND TRACT: BEGINNING at a point on the north line of Seventh Street 105.94 feet west of the northwest corner of Lynn Street and Seventh Street; thence at right angles from Seventh Street in a northerly direction 97 feet, more or less, to a point in the south line of a 15 foot alley; thence in a westerly direction towards Swann Street and with the line of said alley 15.88 feet, more or less, to the line of the lot heretofore conveyed; thence at right angles 97 feet, more or less, to the north line of Seventh Street; thence with the north line of Seventh Street 15.88 feet to the place of beginning.

 

THIRD TRACT: BEGINNING at a stone in the north line of Seventh Street, 23 feet west of the northwest corner of Lynn and Seventh Streets; thence, running at right angles to the line of Seventh, Street, 97 feet, more or less, to the south line of a 15 foot alley at a point therein 23.93 feet west of the west line of Lynn Street; thence 32.94 feet in a westerly direction along the south side of said alley; thence at right angles to the line of said alley southerly and parallel with first course hereof 97 feet, more or less, to the north parallel line of Seventh Street; thence with the north line of Seventh Street in an easterly direction 32.94 feet to the place of beginning, also being known as 725 Seventh Street in the city of Parkersburg, Wood County, West Virginia.

 

FOURTH TRACT: BEING in the City of Parkersburg, District of Parkersburg, Wood County, West Virginia, described as TCT 97 x 23.93 x 97 x 23 Seventh and Lynn Streets.

 

FIFTH TRACT: BEGINNING on the north side of Seventh Street 55.94 feet west of the northwest corner of Seventh Street and Lynn Street at the corner of a lot owned by W. H. Bargeloh; thence at right angles from Seventh Street, in a northerly direction 97 feet, more or less, to a 15 foot alley; thence with the line of said alley, toward Swann Street 46 feet; thence at right angles 97 feet to the north line of Seventh Street; thence with Seventh Street in an easterly direction 46 feet to the place of beginning.

 

SIXTH TRACT: BEGINNING at a point in the north line of Seventh Street, between Swann Street and Lynn Street; which point is the southwest corner of a lot conveyed to John Carras, by C. Goetz, et al, by deed of record in said Clerk’s Office in Deed Book 184, at page 436; thence toward Swann Street with the line of Seventh Street 4 feet; thence at right angles and parallel with the line of the lot above mentioned, 97 feet, more or less to a 5 foot alley; thence at right angles toward Lynn Street 4 feet to the northwest corner of said Carras lot; thence with a line of said Lot 97 feet, more or less, the place of beginning.

 

BEING the same real estate conveyed unto Michael Umensetter and Betty L. Umensetter by Deed dated the 28th day of December, 1995, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book No. 951, at page 663.

 

This conveyance is made subject to all rights-of-way, reservations, restrictions, protective covenants, utility easements, and oil and gas leases of record in the chain of title in the aforesaid Clerk’s Office.

 

AND believed to have a street address of 705 Seventh Street, Parkersburg, West Virginia.

 

The following terms will apply to said sale, to-wit:

 

  1. $5,000.00 in cash or certified funds at sale, with balance due within 14 days or as the Trustee and bidder(s) may otherwise agree at sale.

 

  1. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantor and his predecessors in title prior to the granting of the deed of trust being foreclosed upon.

 

  1. The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned.

 

  1. The undersigned reserves the right to reject any and all bids.

 

  1. Sale is subject to unpaid ad valorem taxes and special assessments, if any, as well as any sale of the subject real estate for unpaid taxes.

 

  1. The premises described hereinabove, including any and all improvements thereto, are sold âAS IS-WHERE ISã with no warranty express or implied.

 

  1. The owner and holder of the indebtedness secured by the deed of trust described hereinabove reserves the right to bid at this sale.

 

  1. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed.

 

  1. Neither the owner and holder of the indebtedness secured by the underlying deed of trust nor the substitute trustee shall have any duty to cause any existing tenant or person or persons occupying the subject property to vacate said property.

 

  1. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s or bidders’ discretion. Any person or entity claiming ownership of or any interest in any such property should contact the undersigned prior to sale about any such claim.

 

  1. The successful bidder at the sale and the Trustee shall execute a Memorandum of Sale at the conclusion of the sale, and the terms of the Memorandum shall control.

 

  1. In the event that the successful bidder at the sale fails or refuses to consummate his, her, its or their purchase, then the Trustee shall have the option to consummate sale with the next highest bidder at the sale.

 

  1. This sale does not include that certain tract described in said Deed of Trust as beginning at a point on the easterly side of Swann Street, and described in a certain Deed dated July 25, 2000, and recorded in Deed Book 1016, at page 89.
