NOTICE OF

TRUSTEE’S SALE

Notice is hereby given that by virtue of the authority under that certain deed of trust executed by Keith T. Good and Tricia L. Good, to Jeffrey S. Bowers, Trustee(s) dated April 20, 2005, and recorded in the office of the Clerk of the County Commission of Pendleton County, West Virginia, in Trust Deed Book 104, at page 146, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated December 9, 2015, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on February 10, 2016 at 11:00 a.m., at the front door of the courthouse of Pendleton County, West Virginia, the real estate conveyed by said deed of trust and situate in Mill Run District, Pendleton County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was: 2.4 ac Ridge Road, Upper Tract, West Virginia, and being more particularly bounded and described therein as follows:

That certain real estate, together with the buildings and improvements thereon located, situated, lying and being in Mill Run District, Pendleton County, West Virginia, and being more particularly described by its metes and bounds as follows:

BEGINNING at 5/8″ rebar set by a fallen corner fence post on the southeast side of the Ridge Road and witnessed by a 1-1/4″ x 48″ iron pipe corner of Franklin Tulin N. 39-04 W. 37.69 feet; thence, with the line of Connie Mowery S. 33-04-29 E. 262.39 feet to a 5/8″ rebar set in a wire fence; thence, with a new division line through Edith Good’s 19 acre tract S. 62-24-03 W. 220.29 feet crossing a hollow to a 5/8″ rebar set at the base of the stump of two hickories on the east side of Ridge Road; thence, with the east side of said road for two calls N. 62-001-33 W. 177.38 feet to a point on the bank of the road witnessed by a 3″ bull pine S. 61-02 E. 3.30 feet; thence, N. 51-51-23 W. 185.05 feet to an 11″ hickory stump found in a fence corner; thence, with wire fence N. 26-01-00 E. 96.78 feet to a 9″ hickory in a fence corner; thence, with the south side of Ridge Road N. 66-24-06 E. 247.23 feet to the beginning and containing 2.40 acres, more or less, and being the same real estate granted and conveyed to Keith T. Good and Tricia L. Good by that certain Deed dated April 20, 2005 and recorded in the Clerk’s Office of the County Commission of Pendleton County, West Virginia, in Deed Book 168, at page 539, to which reference is herewith made for all pertinent purposes.

The Grantors further grant and convey unto the Grantee, his heirs and assigns, all rights of way and easements appertaining to the aforesaid real estate.

This conveyance is made subject to all exceptions, reservations, covenants, conditions, easements, and rights-of-ways created or mentioned in prior instruments of record affecting the property herein conveyed.

This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate.

The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale. The West Virginia Housing Development Fund or its designee may purchase the property at any sale.

The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

TERMS OF SALE: Cash in hand on day of sale.
