On May 26, 2015, Tramco Services, Inc. (Tramco) applied to the WV Department of Environmental Protection, Division of Air Quality (DAQ) for a permit to construction an electric motor build and re-build facility located PO Box 770, Williamson, Mingo County, WV at latitude 37.71098N and longitude -82.25683W. A preliminary evaluation has determined that all State and Federal air quality requirements will be met by the proposed facility. The DAQ is providing notice to the public of its preliminary determination to issue the permit as R13-3253.

The following potential emissions will be authorized by this permit action: Particulate Matter less than 10 microns, 2 tons per year (TPY); Particulate Matter, 4 TPY; Sulfur Dioxide, 1 TPY; Oxides of Nitrogen, 5 TPY; Carbon Monoxide, 2 TPY; Volatile Organic Compounds, 11 TPY; Tetrachloroethylene, 8.3 TPY; Xylene, 0.4 TPY; Ethylbenzene, 0.1 TPY.

Written comments or requests for a public meeting must be received by the DAQ before 5:00 p.m. on Wednesday, November 18, 2015. A public meeting may be held if the Director of the DAQ determines that significant public interest has been expressed, in writing, or when the Director deems it appropriate.

The purpose of the DAQ’s permitting process is to make a preliminary determination if the proposed construction will meet all State and Federal air quality requirements. The purpose of the public review process is to accept public comments on air quality issues relevant to this determination. ORDINANCE

Notice is hereby given to any person interested that on October 20, 2015, the Council of the City of Nitro, West Virginia (the “City”) adopted an ordinance which, among other things:

1.Authorized the acquisition and construction of certain extensions, additions, betterments and improvements (the “Project”) to the City’s existing sewerage system (the “System”), the temporary financing of such costs thereof through the issuance of not more than $9,000,000 in aggregate principal amount of Sewerage System Bond Anticipation Notes (the “Notes”), and the permanent financing of such costs thereof through the issuance of not more than $10,000,000 in aggregate principal amount of Sewerage System Revenue Bonds, from time to time in one or more series (the “Bonds”).

2.Directed that the Notes and the Bonds be issued in such principal amounts, bear interest at such rate or rates, not exceeding the then legal maximum rate, mature on such dates and in such amounts and redeemable, in whole or in part, as prescribed in a supplemental resolution.

3. Directed the continuation of the revenue fund and the disposition of the System revenues; provided for the payment of operating expenses of the System and debt service on the Bonds; directed the creation of sinking funds and reserve accounts for the Bonds and continuation of the renewal and replacement fund; and directed the creation of a bond construction trust fund and the disbursement of the Note and Bond proceeds.

4.Provided that the Bonds shall not be or constitute a corporate indebtedness of the City within the meaning of any statutory or constitutional limitations, but shall be payable solely from the Net Revenues of the System; pledged the Net Revenues of the System to payment of the Bonds and established the rights of the registered owners of the Bonds to such Net Revenues; provided certain conditions for the issuance of additional bonds.

5.Provided that the Notes shall not be or constitute a corporate indebtedness of the City within the meaning of any statutory or constitutional limitations, but shall be payable solely from the proceeds of the Bonds to be sold to the West Virginia Water Development Authority on behalf of the SRF Program.

6.Provided for insurance coverage on the Project and the System, enforcement of collection of fees, rates or other charges for the System and other covenants in favor of the registered owners; established the events of default and the remedies of the registered owners; and provided for the modification or amendment of the Ordinance upon the terms and conditions set forth in the Ordinance.

The City contemplates the issuance of the Notes and the Bonds described in, and under the conditions set forth in the Ordinance abstracted above. Any person interested may appear before the Council of the City of Nitro at a regular meeting on November 3, 2015, at 7:00 p.m., in the Council Chambers, City Hall, Nitro, West Virginia, and present protests and be heard as to whether the above-described Ordinance shall be put into effect.

Blasting activities will occur Monday through Saturday from “sunrise to sunset”. No blasting shall be conducted on Sunday. Blasting is to commence on October 21, 2015 and continue through October 21, 2016.

Ten minutes prior to and immediately after each blast, all access to the specific area will be safeguarded from unauthorized entry. The warning signal prior to each blast shall be from an air horn audible to at least one half mile from the blast. The warning will be given three (3) minutes prior to detonation and will consist of three (3) short blasts of five (5) seconds duration with five (5) seconds between each blast. The all clear signal shall be one long blast from an air horn of twenty (20) seconds duration.

Blasting shall be conducted in such a way so as to prevent adverse impacts to the public or the environment.

Blasting activities will not be conducted at times other than those announced in the blasting schedule except in the event of an emergency situation where rain, lightening, or other atmospheric conditions, or operator or public safety requires unscheduled detonations.

Cross referencing on this form to other parts of the prospectus is not acceptable.

A single “Letter of Qualification” and unpriced prospectus is required. All evaluation factors as noted herein before will be given equal consideration in the selection process, unless a project specific weighting of the evaluation factors is shown in the Notice for Consulting Services.

Prior to entering into contract negotiations, the selected firm and any sub-consultants shall submit a current audited overhead rate computation performed by a state or federal government agency or independent CPA firm. The submitted overhead audit shall contain a detailed exhibit of the computations with all applicable eliminations and references. The audit shall be done in accordance with Government Auditing Standards issued by the Comptroller General of the United States and all eliminations required by the Federal Acquisition Regulations will be made. Notice is hereby given that consulting services will be utilized by the West Virginia Department of Transportation, Division of Highways, for Quality Assurance Management (QAM) services and related duties as required for contract document development of the I-70 Interstate in Ohio County, West Virginia to acquire a concession to operate and maintain 14.45 miles of I-70 Interstate. The West Virginia Department of Highways is interested in entering an initial 5 year concession agreement with optional renewal every 5 years. This project is being developed as Public-Private Partnership.

The QAM will be responsible for all Requests for Proposal (RFP) tasks normally performed by the WVDOH. Consultant personnel will act as an extension of WVDOH staff as a Quality Assurance Manager (QAM). These tasks include, but are not limited to:

1) Review of RFQ to see if any addendum is necessary for their QA needs.
2) Review RFQ submissions and attend Evaluation meeting as a non-scoring committee member.
3) Review the RFQ submissions to address whether the prospective Proponents demonstrate the technical capabilities require to operate and maintain a highway with respect to the following areas of expertise:
a) Operation and maintenance of roads, bridges and
tunnels;
b)Capital improvements;
c)Environmental responsibility; and
d)Safety.
4) Development of any and all necessary contract documents (RFP).
5) Aid in answering BidX questions if necessary.
6) Assemble addendums as necessary.
7) Ongoing agency coordination.
8) Attend and help prepare for mandatory pre-bid meeting.
9) Attend proprietary meetings.
10) Review technical proposals for adherence to RFP.

The QAM will be responsible for creating a contract for the concession with the following criteria:

1) Provide operating standards included but not limited to maintenance, operation and procedures, and environmental management.
2) The concessioner will supply experienced construction and materials inspection personnel. All inspectors must be certified through “DOH Technician Certification Board”.
3) The personnel shall have a working knowledge of WVDOT-DOH standards, specifications and materials testing procedures as well as being certified by the DOH for sampling and testing aggregate, portland cement concrete, asphalt, compaction testing and possess nuclear certifications in the State of West Virginia. The knowledge and certifications required of a given individual will depend on the specific item(s) being inspected and /or sampled/tested.
4) It is the intent that the majority of the required materials testing be conducted by personnel capable of performing the complete field inspection of the affected items.
5) In addition the inspectors shall be knowledgeable of good construction practices and surveying practices and procedures; able to interpret contracts, special provisions, plans and specifications; able to exercise good judgment; able to use engineering, test and office equipment; be accurate and neat in recording data and preparing records and able to maintain a harmonious relationship with the Department, other governmental agencies, contractors and the public.
6) The consultant will supply all necessary transportation for its personnel.
7) The concessionaire will familiarize appropriate personnel with the use of its Site Manager and ProjectWise software for preparation and maintenance of project records and documentation and supply Department required forms to the Consultant. However, the concessioner is expected to provide and maintain the appropriate version of Primavera P6 Scheduling software and also the experience level to afford proper review of the Contract Schedule.
8) All testing equipment and incidental tools and supplies are to be furnished by the concessioner unless the Department elects to supply same on a given project.
9) The method of payment for the QAM services provided will be lump sum pay.
10) The QAM agrees that neither it, nor any of its subsidiaries, affiliates, the parent company, or Subconsultants shall contract for the construction of the work contained in the upcoming I-70 interstate concessioner. The QAM also agrees that it shall not perform services for any contractor, subcontractor, or supplier participating in bidding or construction of the work contained in the project, nor shall the QAM negotiate, contract, or make any agreement with contractor, subcontractor, or any supplier participating in bidding or construction of the work contained in the I-70 Interstate concessioner with regard to any of the work or any services, equipment, or facilities to be used during bidding or construction without the express written approval of the Department.

Firms interested in being considered for this work must submit a letter of interest and unpriced prospectus to Mr. Jason M. That person shall be located within the office where the work is to be performed, and shall demonstrate sufficient past experience performed for the State of West Virginia, Department of Highways related to the Statewide Right-Of-Way Services as previously described. This individual shall be the person-in-charge overseeing the work and must be readily accessible to the Department, preferably located in-state.

2.Consideration shall be given to specialized experience and technical competence. Specialized experience shall focus on the qualifications of the staff working on the project with emphasis placed on individual specialized expertise required for the project. As a minimum, the firm shall provide a Résumé of those individuals who will be committed to the needs of the project. Strong considerations will be based on the professional and non-professional staff specialized experience and technical competence stationed within the office where the work is to be performed.

3.Capacity consideration shall be made on the firm’s ability to accomplish the work within the Department’s required schedule time frame; personnel dedicated to perform such work.

4.Past performance on contracts with Government agencies and private industry in terms of cost control, quality of work, and compliance with performance schedules.

5.Location shall be based on the geographic location of the Consultant’s office relative to the project site along with past experience and knowledge of the area where the project site is located with the significant importance being given to accessibility of the office location relative to the Department.

In addition to the above evaluation factors, the prospectus shall include, as a minimum, the following items:

1.A completed copy of the Division’s Consultant Confidential Qualification Questionnaire dated January 1, 2015 or later, if not already on file. It must specifically indicate the staff levels by classification located in-state vs. out-of-state.

2.Location of office or office(s) in which the work, or part of the work, will be performed.

3.Identification of subconsultants or subcontractors by name as to the type of work anticipated to be subcontracted or performed, if proposed as part of the design team.

4.Indication of whether a cost accounting system has been maintained and is in effect such that it is capable of segregating and identifying accumulating costs for each job that is performed under cost type projects.

5.Completed copies of the Division’s “Consultant Short List Selection Criteria Technical Evaluation” form limited to a single page of data. One loose leaf copy of form is to accompany the bound unpriced prospectus. Cross referencing on this form to other parts of the prospectus is not acceptable.

A single “Letter of Qualification” and one unpriced prospectus are required and must contain all of the above information required to be considered. Failure to provide the required information and/or insufficient information will cause disqualification and the prospectus will be returned. All evaluation factors as noted herein before will be given equal consideration in the selection process, unless a project specific weighting of the evaluation factors is shown in the Notice for Consulting Services.

Prior to entering into any contract negotiations, the selected firm and any subconsultants shall submit a current audited overhead rate computation performed by a State or Federal government agency or independent CPA firm. The submitted overhead audit shall contain a detailed exhibit of the computations with all applicable eliminations and references. The audit shall be done in accordance with Government Auditing Standards issued by the Comptroller General of the United States and all eliminations required by the Federal Acquisition Regulations will be made. The submitted certified audited overhead (Indirect Cost Rate) report shall include the certification, certifying that the allowability of costs used to establish the final indirect cost rate are in accordance with the FAR cost principles, or a verification indicating this certification was previously submitted and accepted by the cognizant agency.
