IMPACT AND
NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Marion County Commission for Colfax PSD Sanitary Sewer.
REQUEST FOR RELEASE OF FUNDS
On or after Friday, November 18, 2016 the Marion County Commission will submit a request to the West Virginia Development Office for the release of HUD Small Cities Block Grant funds under Title 1 of the Housing and Community Development Act of 1974, as amended, to undertake the following project:
Project Title: Colfax PSD Sanitary Sewer Improvements and Upgrade Project
Purpose: Construct an alternative to the existing sewer package plant for Colfax
Location: Intersection of County Route 66 and Route 33/1 in Colfax
Estimated Cost: $1,261,306 SCBG and $641,500 WV DEP
FINDING OF NO SIGNIFICANT IMPACT
The Marion County Commission has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file and display at Region VI Planning and Development Office at 34 Mountain Park Drive, White Hall, WV near White Hall Elementary School, where the ERR with all relevant comments and recommendations may be examined or copied weekdays 9:00 A.M to 4:00 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the Marion County Commission C/O Region VI PDC the designated agency assisting the County Commission in receiving and responding to comments. All comments received by Friday, November 18, 2016 will be considered by the Marion County Commission and Colfax PSD prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

RELEASE OF FUNDS

The Marion County Commission certifies to the West Virginia Development Office that Ernie VanGilder, in his capacity as President of the Marion County Commission consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The West Virginia Development Office’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Marion County Commission to use HUD program funds.
OBJECTIONS TO RELEASE OF FUNDS
The West Virginia Development Office will accept objections to its release of funds and the Marion County Commission certification for a period of fifteen days following the anticipated submission date of Tuesday, December 6, 2016 or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Marion County Commission; (b) the Marion County Commission has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the West Virginia Development Office; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the West Virginia Development Office at Building 6 Room 553-B State Capitol Complex, Charleston, WV 25305-0311. Potential objectors should contact the WVDO to verify the actual last day of the objection period.
