of Rules Governing Telephone Conduit Occupancy,

NOTICE OF COMMENT PERIOD & HEARING
On June 7, 2016, the Public Service Commission promulgated proposed Rules Governing Telephone Conduit Occupancy (Telephhgone Conduit Rules), 150 C.S.R. Series 37, pursuant to Senate Bill Number 678, which passed in the 2016 Regular Session of the West Virginia Legislature and will be codified as W.Va. Code § 24-2E-3. The new rules prohibit a telephone public utility from preventing a customer who has paid for conduit or other underground construction from using that conduit or other underground construction for purposes other than services provided by the telephone company, so long as the customer and all occupants comply with the national electrical safety code and regulations to be promulgated by the Commission.
