NOTICE OF
TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated January 7, 2005, executed by the Borrower, Lori L. Archbold, to Richard Pill, the Trustee, of record in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Book 1256, at Page 213, and re-recorded in Book 1257, at Page 55. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 15 Saint Charles Avenue, Wheeling, WV 26003. Pill & Pill, PLLC was appointed as Substitute Trustee by a Substitution of Trustee dated September 21, 2016, of record in the Clerk’s Office in Book 1532, at Page 693. The Borrower defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Ohio County, in Wheeling, West Virginia, on the following date:
November 23, 2016
at 11:00 a.m.
The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Triadelphia / Wheeling District, Ohio County, West Virginia, and being more particularly described as follows:

Situate on the southerly side of St. Charles Avenue, Triadelphia District, Ohio County, West Virginia and comprising all of Lots 15 as shown on the Plat of Royal Oaks Estates recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Plat Book 4, at page 113, and being more particularly bounded and described as follows:

Beginning at a point in the southerly line of the 42 and 08/100 acre tract of land that was conveyed by Robert P. Fitzsimmons and Sunni L. Fitzsimmons, his wife, and Steve Vogrin and Michelle Vogrin, his wife, to Royal Oaks Estates, Inc., by deed dated June 7, 1991, and recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 660, at page 903 and of which the herein described parcel is a part, at its intersection with the division line between Lots 15 and 16 as shown on said plat, said beginning point being located the following two (2) bearings and distances from a point at the southwesterly corner of said 42 and 08/100 acre tract; 84 degrees 24′ 22″ E. 648 and 55/100 feet to a point; thence S. 81 degrees 09′ 08″ E. 358 and 63/100 feet to said beginning point; thence from said beginning point and with said division line N. 05 degrees 05′ 27″ E. 220 and 77/100 feet to a point in the southerly line of St. Charles Avenue; thence with same S. 84 degrees 54′ 38″ E. 100 feet to a point in the division line between Lots 14 and 15; thence with same S. 05 degrees 05′ 27″ W. 227 and 34/100 feet to a point in the southerly line of said 42 and 08/100 acre tract; thence with same N. 81 degrees 09′ 08″ W. 100 and 22/100 feet to the place of beginning, containing by calculations made by Stegman & Schellhase Inc., Civil Engineers and Surveyors, five thousand, one hundred forty-four ten thousandths (5144/ 10,000) acres more or less.

There is also granted to the parties of the second part hereto, all rights of ingress and egress now enjoyed by the party of the first, hereto, over St. Charles Avenue and the road leading to Parkview Hill Road.

Said parcel being subject to a 20 foot front building line and a 5 foot wide utility easement within said 20 feet along St. Charles Avenue and also subject to an easement for a sanitary sewer, 15 feet wide, as the same passes through said parcel.
There is excepted and reserved from the lots shown on this plat all of the coal and minerals underlying the same together with the right to mine said coal and minerals.
Subject property hereby conveyed is subject to any and all rights of way and easements for utility purposes including, but not limited to, electricity, gas, telephone, water, sewage and roadways, which now exist or which may be hereinafter necessary in order to service all lots within Royal Oak Estates, Inc. and/or as are set forth on the unrecorded Preliminary Plan of Lots known as Royal Oak Estates, Inc. which was preformed by Stegman & Schellase, Inc.

Being the same property conveyed to Lori L. Archbold by the Deed dated January 7, 2005 and recorded in Deed Book 756, at Page 769, in the Office of the Clerk of the County Commission of Ohio County, West Virginia.

TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Section 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
