TRUSTEES’ SALE OF VALUABLE
REAL ESTATE

The undersigned Trustees, by virtue of the authority vested in them by that certain deed of trust dated June 15, 2007, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book 1329, at page 315, Chad W. Hixenbaugh did convey unto Experienced Title, Inc., Trustee, certain real property described in said deed of trust; and the beneficiary has elected to appoint Terra Abstract Trustee West Virginia Inc. as substitute Trustees by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned deed of trust and the undersigned Trustees, having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse, 1500 Chapline Street, Wheeling, West Virginia 26003 on:

The following parcel of Real Estate being known as Lots Numbered One (1), Two (2), Three (3) and Four (4) in the “Criss Division” of the Village of Potomac, and further bounded and described as follows:

Beginning at a stake standing on the edge of the old road leading from Potomac to West Liberty, at the Southwest corner of Lot Numbered Four (4); thence running S. 29-1/2 degrees E 4-5/10 rods to a willow corner to property formerly owned by G.E. Curtis; thence S 81-3/4 degrees E 15-5/10 rods to the line of lands formerly owned by John Rodgers now a part of Faris lands, and a part of the property conveyed by this Deed; thence down Castleman’s run, with the Rodgers line, N 8-3/4 degrees E 15 rods to the Northeast corner of Lot Numbered One (1); thence N 80 degrees W along the line of lands formerly owned by H.L. McCammon; thence along the Potomac and West Liberty (Old Road), S 55-1/2 degrees W to the Place of Beginning, and containing one and one-half (1 and 1/2) acres, more or less; said Lot Numbered One (1) being the same lot that was conveyed to J.C. Faris by J.C. Criss and wife by Deed dated January 22, 1882, and recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia in Deed Book 72, at Page 100; said Lots Numbered Two (2), Three (3) and Four (4) being the same lots that were conveyed to J.C. Faris by George Rice and wife by Deed dated November 10, 1881 and recorded in the aforesaid County Clerk’s Office in Deed Book 72, at Page 59.

Also a tract of land adjoining the lots above described on the East side thereof, and bounded as follows:
Beginning at a stone on the West side of Castlemans Run, and running thence S 44-1/2 degrees E 10-4/10 rods to a willow; thence S 20 degrees W 23 rods to a White Oak; thence S 35 degrees W 23 rods to a stone; thence W 3 rods to a stone; thence N 9 degrees E 57 rods to the Place of Beginning, and containing three acres, three rods and twenty-seven perches, coal and all.

The aforesaid property is SUBJECT TO any and all easements, rights- of-way, conditions, covenants and restrictions of record or in existence.
The sale of the foregoing real property will be made subject to all exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record, if any, pertaining to said real estate, subject to all matters disclosed by an examination and inspection of the property, subject to any and all unpaid taxes as recorded against said property, and to any further matters announced at said sale. The property is sold subject to an accurate survey at purchaser’s expense.
The sale of the foregoing real property will also be made expressly subject to any and all other deeds of trust, judgments, liens, and all other encumbrances of any nature whatsoever, if any, having priority over the deed of trust referred to herein.
The Trustees reserve the right to adjourn the sale, for a time, or from time to time, without further notice, by announcement at the time and place of sale describe above or any adjournment thereof. The Trustees reserve the right to reject any and all bids.
The subject property will be sold in “AS IS” condition. The Trustees shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. The Trustees will deliver a trustees’ deed to the purchaser without any covenant or warranty (express or implied) in the form prescribed by W. Va. Code Section 38-1-6. The Trustees make no representations and warranties about the title of the real estate to be conveyed. If the Trustees are unable to convey insurable or marketable title to purchaser for any reason, purchaser’s sole remedy is return of deposit.
TERMS OF SALE: $5,000.00 cash in hand at the time of sale in the form of a certified check or cashier’s check made payable to “Terra Abstract Trustee West Virginia Inc.,” and the balance in cash closing within 30 days of the date of the sale. Purchaser shall pay for transfer stamps and recording fees. Additional terms of sale may be announced prior to the sale.
