NOTICE
PUBLIC NOTICE OF CHANGE IN RATES UPON APPLICATION
WITHOUT PROPOSED EFFECTIVE DATES
NOTICE is hereby given that Lackawanna Transport Company d/b/a Wetzel County Landfill, a commercial solid waste facility and a public utility, has, on August 9, 2016, filed with the PUBLIC SERVICE COMMISSION OF WEST VIRGINIA an Application containing increased rates, tolls and charges for furnishing landfill waste disposal services to approximately 125 customers at the Wetzel County Landfill in New Martinsville, West Virginia.

The Wetzel County Landfill is owned and operated by Lackawanna Transport Company, a West Virginia corporation, and the Landfill operates under authority of a Solid Waste Facility Permit issued by the West Virginia Department of Environmental Protection and a Certificate of Need issued by the West Virginia Public Service Commission.

The Applicant is seeking an increase in its base disposal tariff rate at the Wetzel County Landfill for non-specialty waste from $20.00 per ton to $27.35 per ton. The Applicant has not had an increase in its disposal rate since 1989, a period of 27 years. The proposed increased rates and charges will produce approximately $1,200,000 annually in additional revenue, an increase of 36.75{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}. The Applicant’s present authorized rates and its proposed rates are as follows:

Both the present and proposed rates referenced above are exclusive of any legislatively mandated or authorized per-ton assessment fees and any other per-ton assessment fees due to any governmental entity.

The increases shown are based on averages of all customers in the indicated class. Each class may receive increases that are greater or less than stated here. The requested rates and charges are only a proposal, and are subject to an approval, denial or modification (increases or decreases) by the Public Service Commission in its review of this Application. Any increase in rates will not become effective until authorized and approved by the Commission. If a hearing is scheduled, notice will be given of the time and place of hearing.

Anyone desiring to protest this proposed change in rates or to intervene should file a written protest or notice of intervention prior to December 31, 2016 unless the Commission, by Order, specifies a different date. Failure to file a timely protest or notice of intervention may affect your rights to protest any rate increases and to participate in future proceedings in this case. All protests or requests to intervene should briefly state the reason for the protest or intervention. Requests to intervene must comply with the Commission’s rule on intervention set forth in the Commission’s Rules of Practice and Procedure. All protests and notices of intervention should be addressed to the Executive Secretary, Public Service Commission of West Virginia, P.O. Box 812, Charleston, West Virginia 25323.

A complete copy of the Applicant’s present authorized rates and of its proposed rates, as well as a representative of the Applicant to provide any information requested concerning the proposed changes, is available to all customers, prospective customers, or their agents at the office of the Applicant at: 1521 Wetzel County Landfill Road, New Martinsville, West Virginia 26155.

A copy of the Applicant’s present authorized rates and its proposed rates is also available for public inspection at the office of the Executive Secretary of the PUBLIC SERVICE COMMISSION at 201 Brooks Street, Charleston, West Virginia.
