NOTICE
Notice of Pendency of Class Action and Settlement
The following statement is being issued by the Fitzsimmons Law Firm PLLC regarding litigation concerning the water outage and disruption of water service to customers of the Weirton Area Water Board and/or City of Weirton from June 10, 2011 through June 17, 2011.
If you were a customer of Weirton Area Water Board and/or City of Weirton from June 10, 2011 through June 17, 2011, you may have a claim to receive benefits in a proposed class action settlement.
The purpose of this notice is to inform you of the pendency and settlement of a class action entitled Ronald A. Gable, Jr., Individually and on Behalf of All others Similarly Situated vs. The James White Construction Company, Weirton Area Water Board, and City of Weirton, Civ. Act. No. 11-C-91, pending in the Circuit Court of Brooke County, West Virginia. The Court has scheduled a settlement approval hearing on December 10, 2015 at 10:00 a.m. at the Brooke County Courthouse, 302 Courthouse Square, Wellsburg, WV 26070, in the courtroom of Judge Jason A. Cuomo.
In this action, Plaintiff Ronald A. Gable, Jr. alleges on behalf of himself and prospective class members that the water outage and disruption of water service to customers of the Weirton Area Water Board and/or City of Weirton from June 10, 2011 through June 17, 2011 resulted in damages to the affected customers. The Defendants denied and continue to deny these claims.

A copy of the Settlement Agreement, the Notice of Settlement, information on how to object or be excluded from the Class, and other important documents and information are also available for inspection or copying at the Brooke County Circuit Clerk’s office.
You may be entitled to receive a monetary payment if: (a) you were a customer who purchased water from Weirton Area Water Board and/or the City of Weirton during June of 2011; and (b) your water service was disrupted at any time between June 10, 2011 and June 17, 2011. You may also elect to exclude yourself from the settlement. If you are a member of the Settlement Class and do nothing – meaning that you do not submit a request to be excluded – you will receive benefits under the settlement, and will be bound by any final judgment approving the proposed Settlement.
