PUBLIC NOTICE OF VOLUNTARY REMEDIATION PROGRAM SITE CLEANUP METHOD PUBLIC NOTICE NO.: VRP #05132-002 PAPER: Fayette Tribune PUBLIC NOTICE DATE: April 21, 2016 The Office of Environmental Remediation (OER) at the West Virginia Department of Environmental Protection has approved a cleanup method to address environmental conditions at former Chevron Facility #204779 under the Voluntary Remediation and Redevelopment Act. The applicant, Chevron Environmental Management Company, has been working with the WVDEP since negotiating a Voluntary Remediation Agreement (VRA) on April 12, 2004. The site is located at 131 South Court Street, Fayetteville, Fayette County, West Virginia, and is comprised of approximately 0.185 acres of property. The site was formerly used as an automotive service and fueling facility. Site improvements included a +/- 3,900 ft2 shop with multiple repair bays, two 2,000 gallon (removed) and one 1,000-gallon gasoline underground storage tanks (USTs) (closed in place), a dispenser island (removed), and associated piping (in-place) on an asphalt/concrete lot. The shop building remains on site. A series of environmental investigations beginning in 2001 indicated that soil and shallow groundwater at the site are impacted with petroleum hydrocarbon compounds. Quarterly monitoring and sampling was initiated during the third quarter 2002 and continued through the fourth quarter 2005. Semi-annual M&S was conducted in 2006 and 2008. In accordance with email correspondence from the WVDEP dated August 27, 2008, groundwater samples were collected quarterly from monitoring well MW-4 and semi-annually from monitoring well MW-6 from January 2009 through January 2010. The additional monitoring and sampling of monitoring well MW-4 was required to further establish decreasing trends of benzene concentrations compared with the varying seasonal water levels observed at the Site. Additional monitoring and sampling of monitoring well MW-6 was to confirm historic non-detection trends and to ensure the plume was not migrating across Fayette Avenue. A land use covenant has been negotiated to put the following institutional and engineering controls in place at the Site: restriction on groundwater withdrawal for purposes other than monitoring or remediation, and; restriction of property to non-residential use only as that term is defined in 60CSR3. The land use covenant was recorded on January 13, 2016, in Deed book 730 page 438 with the property deed to ensure that the restriction remains in place in the event that the property is transferred to new ownership.
