NOTICE OF
TRUSTEE’S SALE
Under authority of that certain Deed of Trust dated May 21, 1999, from Robert E. Simms and Kelly L. Simms to Anthony J. Julian, Trustee, of record in the office of the Clerk of the County Commission of Marion County, West Virginia in Trust Deed Book No. 677, at page 877, securing a promissory note in the principal amount of $53,039.30, payable to Chase Manhattan Bank USA, N.A., and default having been made pursuant to the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., as Assignee of the aforesaid Deed of Trust, the undersigned Substitute Trustee will offer for sale at the front door of the Marion County Courthouse in Fairmont, West Virginia on October 25, 2016 at 10:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, all of that certain tract or parcel of real estate, together with the improvements, privileges and appurtenances thereunto belonging, situate on the waters of Dunkard Mill Run, West Augusta (Lincoln) District, Marion County, West Virginia, described as follows:
BEGINNING at an iron pin located on the boundary line of land belonging to John E. Amos, Jr., and located on the western line of the County Road leading to Bethel, and running thence with the western line of said road, S. 3° 22’ E. 130.01 feet to an iron pin; thence continuing with the County Road, S. 13° 05’ E. 156.75 feet to an iron pin; thence leaving the County Road and running through the land of John E. Amos, Jr., S. 77° 30’ W. 235.87 feet to an iron pin; thence N. 8° 23’ W. 354.0 feet to a post located on the out boundary line; thence running with said line, S. 86° 0’ E. 239.36 feet to the place of beginning, and containing 1.682 acres, more or less.
Being the same property conveyed from Kelli McVicker and Ray McVicker, her husband, to Kelly L. Simms and Robert E. Simms, her husband, by Deed dated September 8, 1992, of record in the aforesaid Clerk’s office in Deed Book No. 905, at page 496.
Terms of the sale: cash on date of sale.
