NOTICE OF TRUSTEE’S SALE and Notice of the Beneficiary/Servicer’s election to sell property is hereby given pursuant to and by virtue of the authority vested in the Trustee by that certain Deed of Trust dated August 28, 2003, executed by Melessia Sloan to Jenny N. Phillips, Trustee, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Book 778, at Page 976. Hereford & Riccardi, PLLC was appointed as Trustee by SUBSTITUTION OF TRUSTEE dated November 9, 2016, of record in the Clerk’s Office in Book 1159, at Page 109. The borrowers defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Marion County, in Fairmont, West Virginia, on:

All that certain parcel of land of the following two (2) described lots in Huey Addition to Homewood, a plat of said Addition being of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 541, at Page 509, and being Lot No. 5 and Lot No. 6 of Block “A” to said Huey Addition, and a plat of Block “A” of Huey Addition being also being of record in the aforesaid Clerk’s Office in Deed Book No. 486, at Page 80; however a new survey having neem conducted of Lot No. 5 and Lot No. 6 in Block “A”, and a new plat being attached to deed and being more particularly bound and described as follows:
BEGINNING at an iron pin, corner to Flaggy Meadow Road, being a common corner to Lot No. 6 and Lot No. 7, and running thence with Lot No. 7, N. 29˚ 47? W. 110.12 feet to an iron pin, corner to Huey Street; thence with Huey Street, N. 60˚ 30? 100.00 feet to an iron pin, corner of Lot No. 5 and Lot No. 4; thence with Lot No. 4, S. 29˚ 47?E. 110.12 feet to an iron pin, corner to Flaggy Meadow Road; thence with Flaggy Meadow Road, S. 60˚ 30? W. 100.00 feet to the place of beginning, containing 11,012 square feet, more or less.
This conveyance is made subject to all of the exceptions, reservations and conditions which contained in prior deeds in the chain of title, and also any right of ways and any out-conveyances of coal, oil and gas, and other minerals, which the Grantors were subject to in their ownership of this property, only to the same extent that they are still in effect.
This is the same property conveyed to Melessia Sloan by deed dated August 26, 2003, of record in the Clerk’s Office in Book 986, at Page 1027.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-2.
3) Real estate taxes due and payable have been paid. All real estate taxes hereafter will be the responsibility of the purchaser.
4) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
5) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
6) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
