NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated April 22, 2009, executed by Borrower(s), Christina M. Dotson and Frank G Dotson, Jr., to Jefferson L. Triplett, the Trustee of record in the office of the Clerk of the County Commission of Tucker County, West Virginia, in Book 238, at Page 89. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 521 Limestone Road, Parsons, WV 26287-. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 16,2016, of record in the Clerk’s Office in Book 276, Page 400. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Tucker County, in Parsons, West Virginia, on the following date:

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Saint George District, Tucker County, West Virginia, and being more particularly described as follows:

TRACT ONE: Beginning at a point in a line of Ashby and the center line of a power line, set a steel rod, corner to Tract I, thence with. Ashby for two lines
S. 1-28-50 E. 572.50 feet to a point, set a steel rod, thence
S. 63-07.08 E. 214.44 feet to a point, corner to Lipscomb, thence with Lipscomb for one line
S. 71-57-30 W. 901.62 feet to a point, set a steel rod, corner to Mammola, thence with Mammola for one line
N. 40-45-39 W. crossing a set steel rod at 1078.10 feet continuing in all 1098.10 feet to a point in the centerline of an existing road, corner to Rogers, thence with Rogers and said centerline for one line
N. 56-54-24 E. 338.33 feet to a point at the intersection of said road centerline and a power line, corner to Tract 1, thence with said power line and Tract I for one line
S. 86-24-52 E. 1086.86 feet to the beginning, containing 22.53 acres as surveyed by James T. Carr, P.S. #920 in February 1997 and as shown on that certain plat for Frank G. Dotson recorded in the Office of the Clerk of the County Commission of Tucker County, in Plat Cabinet 2, at Sheet 242.
Being part of the same real estate conveyed unto Frank G. Dotson, Jr. and Christina M. Dotson, husband and wife by deed of Frank G. Dotson (single), bearing date of March 16, 1997 and of record in the Office of the Clerk of the County Commission ofTucker County, West Virginia in Deed Book 155, at Page 5.
There are further conveyed unto the grantors, a right of way through the lands of William E. Deets and Charles L. Deets, as conveyed by prior instruments along the South Side of Laurel Run to the County Road on the East Side of Cheat River.
This conveyance is made subject to any and all reservations, restrictions, exceptions, covenants, agreements, right-of-way and casements as may be set forth in prior instruments of record in the chain of title to said real estate.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
