TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated July 16, 2007, and duly recorded in the Office of the Clerk of the County Commission of Tucker County, West Virginia, in Deed of Trust Book 225, at Page 318, David A. Johnson and Ellen M. Johnson did convey unto Pat A. Nichols, Trustee, certain real property described in said Deed of Trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Tucker County Courthouse, in Parsons, West Virginia, on
Monday, October 3, 2016, at 9:00 AM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Fairfax District, Tucker County, West Virginia, and more particularly described as follows:
The following pieces or parcels of real estate, situate in the Village of Benbush, Tucker County, West Virginia, described as follows, to-wit:
(1) All that certain lot being Lot No. 11 in the Village of Benbush, Fairfax District, as shown
and described on a map or plat of record in Deed Book No. 59 at Page 89 and which plat is
designated as Plat B and reference is hereby made to said plat for a more specific descrip-
tion of said lot.
(2) Tract B (Lot 1 0/A) – Beginning at a concrete monument in the easterly line of State
Secondary Route 18, thence along said line N. 11 deg. 19’ 30” E. a distance of 94.80 feet to a
3/4” x 30” rebar set at the southwesterly corner of Lot 11; thence along the southerly line of
Lot 11 S. 74 deg. 30’ E. a distance of 150.00 feet to a 3/4”x 30” rebar set at the southeasterly
corner of said Lot 11; thence along the easterly line of the tract hereby described S. 11 deg.
04’ 50” W. a distance of 79.76 feet to the northeasterly corner of Lot 10; thence along the
northerly line of said Lot 10 N. 80 deg. 15’ W. a distance of 150.00 feet to the beginning,
containing 0.300 of an acre, more or less.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing
address of HC 60 Box 168, Thomas, WV 26292.
AND BEING the same real estate which was conveyed to David A. Johnson and Ellen M. Johnson by deed dated March 28, 2007, from Kenneth G. Bible and Beverly A. Bible, and recorded in the Office of the Clerk of the County Commission of Tucker County, West Virginia, in Deed Book 190, at Page 425.
The above described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.    ______________________________
