TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 10, 2001, and duly recorded in the Office of the Clerk of the County Commission of Tucker County, West Virginia, in Book No. 168, at Page 409, Farren G. Falls and Regina L. Falls did convey unto Law Offices of David Sims, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated February 6, 2018, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by 21st Mortgage Corporation to foreclose thereunder, will offer for sale at public auction at the front door of the Tucker County Courthouse in Parsons, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Licking District, Tucker County, West Virginia, and more particularly described as follows:
A tract or parcel of land situate on WV State Route 72, on the east side thereof at the old Town of Hannahsville, 6.8 miles northeast of the Saint George Intersection with Tucker County Route 5 and being on the waters of Cheat River, Licking Creek District, Tucker County, West Virginia, more particularly described as follows:
Beginning at a point on the eastern right of way of WV State Route 72, 45 feet from the centerline thereof a corner to WV State Road Commission (Deed Book 72 at Page 354 ), said point being on the arc of a 4° 11’ curve to the right, having a radius of 1367.23 feet and a central angle of 6° 06’, set a 3/4 inch by 42 inch rebar with a 2 3/4 inch diameter plastic cap, from which the end of a guard rail bears S 72° 40’ W, 38.1 feet, a power pole bears S 45° 45’ W, 92.8 feet, another power pole bears N 18° 15’ E, 78.1 feet, and from which an outlet of a 18 inch cmp opposite centerline station 221 + 25 (project S228 (8)) bears S 28° 01’ W, 177.64 ft. thence with the eastern right of way of said Route 72 and the arc of said 4° 11’ curve
CHORD = N 34° 45’ E. 145.65 Feet to a point on the eastern right of way of said WV State Route 72, being on the arc of said 4° 11’ curve to the right and 45 feet from the centerline of paved road, set a 3/4 inch by 42 inch rebar with a 2 3/4 inch diameter plastic cap, from which a 2 inch iron pipe, found, the northeast corner of Snider – Deed Book 100 at Page 304, bears N 33° 58’ E, 563.55 feet, thence through the parent Eugene and Virginia Bohon tract of Deed Book 100 at Page 333 for three lines S 52° 34’ E, 250.00 Feet to a point, a corner to proposed Lot B, set a 3/4 inch by 42 inch rebar with a 2 3/4 inch diameter plastic cap, thence with said proposed Lot B S 35° 53’ W, 177.28 Feet to a point, a corner to said proposed Lot B, set a 3/4 inch by 42 inch rebar with a 2 3/4 Inch diameter plastic cap, thence N 45° 16’ W, 250.00 Feet to the point of beginning, containing 0.92 acres, more or less, as surveyed in July 2001 by Leon G. Mallow, Professional Surveyor No. 567, Route 1, Box 117, Montrose, WV 26283.
SUBJECT TO a 40 feet wide by 75 feet long designated and common-use road right of way at the southwest corner of the above described Parcel for ingress and egress from State Route 72 to the remaining property of Eugene and Virginia R. Bohon and for access to said Parcel.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: Rt. 1 Box 388, St. George, WV 26287 aka 12094 Cheat Valley Hwy, Parsons, WV 26287.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $6000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
