TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated April 23, 2004, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Document No. 2004503777, in Book No. 712, at Page 450, Susan M. Stover and Rickey D. Stover did convey unto Mitchell Lee Klein, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated May 10, 2013 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by U.S Bank National Association, as Trustee for Terwin Mortgage Trust 2004-7HE, Asset-Backed Certificates, Series 2004-7HE to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse in Fayetteville, West Virginia, on January 4, 2017 at 4:00 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Oak Hill District, Fayette County, West Virginia, and more particularly described as follows: Situate in the City of Oak Hill, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit: TRACT NO. 1 – Beginning at an iron rail on the south side of a 15 foot alley that runs parallel with and 150′ from the south side of West Highland Avenue, said iron rail being at the south end (terminus) of Painter Street, and running S 36 f15’W 100 feet to an iron rail; thence running N 55 f06’W 112.2 feet to an iron rail in the line of Cummings; thence running up the hill with said Cummings; thence running up the hill with said Cummings N 53 f10’E 104.7 feet to an iron rail in the line of said 15 foot alley S 55 f06’E 81.5 feet to the point of being; all bearings being with reference to the magnetic meridian of 1959 and the lot or parcel containing twenty-two (0.22) hundredths of an acre. The land herein conveyed carries with it the privilege and easement for the reasonable and lawful use of a road which is 12 feet wide leading from the terminus of said Painter Street to the said surface land herein conveyed. TRACT NO. II – BEGINNING at a point on a 15-foot alley and the northernmost corner of the Richard A. Murdock 0.22 acre tract; thence with said alley N 55-06 W 18.5 feet to a point corner to the Richard A. and Mary A. Murdock 0.55 acre parcel; thence with the line of the Richard A. and Mary A. Murdock 0.55 acres parcel S 51-28 W approximately 106.03 feet, more or less, to a point on said line; thence S 55-06 W approximately 15 feet to a T-rail corner to the Richard A. Murdock 0.22 acre tract; thence N 53-10 E 104.70 feet with the line of the 0.22 acre parcel to the point of beginning, all as is shown more fully on a map attached to a deed recorded in Deed Book No. 457 at page 95, and being part of Lot 17, Hillcrest Court, situate in the City of Oak Hill. Being the same property as transferred by Warranty Deed on 12/21/1994 and recorded 12/30/1994 from W. Ray Murdock, Jr. and Jane Murdock to Susan Jane Stover and Rickey D. Stover, J/T/W/R/O/S, recorded in Book 518 and Page 60. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 200 Painter Street, Oak Hill, WV 25901. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
