TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated January 10, 2014, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Document No. 2014000443, in Book No. 925, at Page 608, Tommy E. Reynolds did convey unto Sara Lopez, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated April 6, 2016 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse in Fayetteville, West Virginia, on January 4, 2017 at 4:00 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Valley District, Fayette County, West Virginia, and more particularly described as follows: All that certain lot or parcel of land, together with appurtenances thereunto belonging, lying and being situate in the Village of Boomer, Falls District, Fayette County, West Virginia, and being more particularly designated as Lot No. 109 (One Hundred Nine) as shown on a map filed in the Office of the aforesaid Clerk’s Office on the 23rd day of September 1955, in Map Book 14 at pages 5 and 6, and designated “Map Showing Boomer Addition, Section One, Electro Metallurgical Company, Falls District, Fayette County, W.Va., EBL-101,” and dated August 25, 1955, reference to which map is here made for a further and more particular description of the lot or parcel of land hereby conveyed. This deed is made and accepted subject to all those several exceptions, reservations, restrictions, conditions and covenants which are presently enforced, as are contained in a Deed in the chain of title to this property from Union Carbide and Carbon Corporation to Robert Lee Thompson and Cecil Jewell Thompson, his wife, dated January 5, 1956, and of record in the said Clerk’s Office in Deed Book 198 at page 27, and being the same property as was conveyed to the parties of the first part by deed of Thomas V. Huddle and Gwendolyn Huddle, his wife, dated April 26, 1969, and of record in the said Clerk’s Office in Deed Book 283 at page 201, reference to which said deed being here made for a more complete and accurate recital of all thereof. And being the same real estate conveyed unto Tommy E. Reynolds by Charles Divita, Jr., and Cathy K. Poe, devises of the Last Will and Testament of Alline K. Divita, deceased by Deed dated January 8, 2014 and to be recorded in the aforesaid Clerk’s Office simultaneously herewith as part of this transaction. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 109 A Street, Boomer, WV 25031. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
