The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 3, 2009, and duly recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Document No. 121880, in Book No. 509, at Page 242, Aaron J. Harris did convey unto Vance Golden, Attorney/Golden and Amos, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated March 17, 2016 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by JPMorgan Chase Bank, National Association to foreclose thereunder, will offer for sale at public auction at the front door of the Hampshire County Courthouse in Romney, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Springfield District, Hampshire County, West Virginia, and more particularly described as follows:

ALL that certain lots or parcels of real estate, together with all buildings and improvements thereon and appurtenances thereunto belonging, situate in the Town of Springfield, Springfield District of Hampshire County, West Virginia, and more particularly described as follows:

BEGINNING at an iron pin at the corner of Carl P. Long’s lot, now owned by Mary Susan Milleson, on the East side of State Route 28 and running in a Southerly direction along said Route, 67’ to an iron pin in the corner of Eugene Parsons’ lot; thence with Parsons line in an Easterly direction 278’ to an iron pin in Walter and Frank Fields line; thence with Field’s line Northeasterly 65’ to an iron pin in corner of Carl P. Long, now Mary Susan Milleson lot; thence with Carl P. Long, now Milleson line in a Westerly direction 284’ to the beginning, containing .4257 of an acre ±: and being more particularly described by a new metes and bounds description prepared by M. Virginia Rosenbaum, dated August 17, 1995, as follows:

BEGINNING at an iron pin with cap found at a fence post, a corner of land now or formerly owned by Eugene Parsons on lines of land now or formerly of Walter & Frank Fields; thence from said iron pin and with a line fence passing its end post at 50’, (1) N 45° 37’01” W 278’ to the Easterly side of Route 28; thence with Route 28, (2) S 55°31’23” W 67’ to a common corner with land owned now or formerly by Mary Susan Milleson; thence with Milleson land with a magnetic variance of 2°9’29”, (3) S 45° 50’31” E 284’ to a point on the Fields line; thence with Fields, (4) N 50°30’50” E 65’, passing an iron pin with a cap at 2.85’, to the beginning, containing 0.42 acre ±.

BEING the same property which was conveyed unto Wilson R. Jones and Diane D. Jones, husband and wife, by Maybelle O. Utt, by deed dated July 27, 2005, which is recorded in the Office of the Clerk of the County Commission of Hampshire County in Deed Book 446, at Page 5.

At the time of the execution of the Deed of Trust, this property was reported to have an address of:  8092 Cumberland Road, Springfield, WV 26763.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN:  In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
