The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 1, 2007, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Document No. 525470, in Book No. 1415, at Page 669, Melisa C. Urban and Jeremiah D. Welch did convey unto Century Title & Escrow/Norman L. Fowell, Esq., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated August 17, 2017, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, NA, to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse in Parkersburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Walker District, Wood County, West Virginia, and more particularly described as follows:

 

LOT 1: All that certain lot, tract or parcel of land situate and being in Walker District, Wood County, West Virginia, and more particularly bounded and described as follows:

BEGINNING at a 3/4ã pipe found in the easterly line of Dallison Road, said pipe being in the southerly line of the Dale Epler property, thence with said southerly line N. 87õ 10á E. 189á to a rebar set at the true place of beginning; thence up the North Fork of Stillwell Creek, N. 8õ 43á 04ã E. 202.17á to a rebar set; thence N. 85õ 22á 26ã E. 320á to a point in the original line of the Dale Epler property, thence with said line S. 11õ 39á 25áW. 200á to a rebar set; thence S. 84õ 30á W. 310.62á to the true place of beginning, containing 1.404 acres. Being the same property conveyed unto Carl T. Armor and Diane Armor by Deed dated March 8, 2001, filed for record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 1023, at Page 728. Also being the same property conveyed unto Ginger Epler by Deed dated December 30, 1999, of record in the aforesaid Clerkás office in Deed Book 1009, at page 71. LOT 2: All of that certain lot, tract or parcel of land situate, lying and being in the District of Walker, County of Wood, and State of West Virginia, more particularly bounded and described as follows: BEGINNING at an iron pipe in the southerly line of property now owned by Carl T. Armor and described in Deed Book 534, at page 150, being also a common corner of C. T. Peick property; thence S. 11õ 10á W. and with the Feick line 239..76 feet to a point; thence S. 85õ 46á W. and with the northerly line of Dale Eplerás property 320 feet, more or less, to the center of the North fork of Stillwell Creek; thence in a northerly direction and with the center line of said creek 250 feet more or less, to a point in the southerly line of the Hedrick heirs tract; thence N. 84õ. 55á E. and with the Hedrick heirs; and Annor tract, 156 feet to a W. oak; thence s. 89õ 15á E. and with the Armor line 140.5 feet to the place of beginning, containing 1.72 acres, more or less. There is further granted and conveyed the non-exclusive use of that certain right of way which was conveyed to Carl T. Armor as an appurtenance to a 50 acre tract by deed dated August 7, 1967, and recorded in Deed book 605, at page 603, which right of way first established in the chain of title by deed dated January 2, 1903, and recorded in deed Book 122, at page 540. Being the same property conveyed unto Carl T. Armor and Diane Armor by Deed dated September 18, 1972, filed for record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 605, at Page 603. Also being the same property conveyed unto Walter Epler and Ruby Epler by Deed dated March 9, 1959, of record in the aforesaid Clerkás office in Deed Book 429, at page 269.

 

At the time of the execution of the Deed of Trust, this property was reported to have an address of: RT 2 Box 186, Walker, WV 26180 AKA 70 Snowflake Rd., Walker, WV  26180.

 

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

 

The subject property will be sold in âAS ISã condition.  The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

 

TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

 

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

 

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
