The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated October 20, 2010, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Document No. 661614, in Book No. 1625, at Page 181, Daniel Thomas and Jennifer R Thomas did convey unto Gregory A. Tucker, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated October 26, 2017, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by U.S. Bank National Association to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse in Parkersburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Vienna District, Wood County, West Virginia, and more particularly described as follows:

 

Situate in the City of Vienna, County of Wood, and the State of West Virginia, more particularly bounded and described as follows, to wit:

 

Beginning five feet north of the southerly line of Evergreen Addition to the City of Vienna where the same intersects the easterly line of Grand Central Avenue, said point being the northwesterly corner of the tract heretofore conveyed to Roy J. Givens and Claudia M. Givens, husband and wife, by the Hubbard Heirs, by Deed of record in the Office of the Clerk of the County Commission of Wood County, West Virginia; thence S. 63õ30á E. 140 feet to a stake; thence S. 28õ 6á W. 61/50 feet to a stake; thence N. 63õ 30á W. 140 feet parallel with a line of an 18 foot easement hereinafter described, to a point on the easterly side of Grand Central Avenue; thence N. 28õ 6á E. with the easterly line of Grand Central Avenue 61.50 feet to the place of beginning being a lot front 61.50 feet on Grand Central Avenue and extending back between parallel lines 140 feet as more particularly shown by the plat attached to the aforesaid Deed. There is further GRANTED and CONVEYED by the parties of the first part to the parties of the second part, their heirs and assigns forever, for the consideration aforesaid, an easement on an 18 foot private driveway running the distance 140 feet along the southern line of the tract hereby conveyed for ingress and egress to said property. There is EXPECTED and RESERVED from this conveyance an easement for right of way for sewer, water and gas lines, which now cross the property hereby conveyed, along with the necessary rights to remove, replace, repair, and maintain said lines, said easement and right of way having heretofore been excepted and reserved for the benefit of the said Roy J. Givens and Claudia M. Givens, husband and wife. BEING the same real estate conveyed unto Daniel R. Thomas by a Deed dated February 9, 2000, and appearing of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book No. 1010, at page 75. This conveyance is made subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations and leases, appearing in the chain of title.

 

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 3800 Grand Central Ave, Vienna, WV 26105.

 

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

 

The subject property will be sold in âAS ISã condition.  The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

 

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

 

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

 

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
