TRUSTEE’S SALE OF VALUABLE REAL ESTATE

THURSDAY, DECEMBER 15, 2017, AT 10:00 A.M.

The herein described real estate of Willard E. Bergdoll, III, shall be sold at public auction on the Courthouse steps in Romney, Hampshire County, West Virginia, on Friday, December 15, 2017, at 10:00 a.m.

Said real estate will be sold pursuant to the authority vested in the undersigned, by the provisions of that certain Deed of Trust executed by Willard E. Bergdoll, III, Willard E. Bergdoll, and Peggy Ann Bergdoll, unto H. Charles Carl, III, and/or William C. Keaton, Trustees, to secure unto The Bank of Romney, a banking corporation, the beneficial owner of that certain Deed of Trust, dated the 17th day of November, 2009, and of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book 508, at Page 396. Default having occurred relative to the covenants and conditions as set forth in said Deed of Trust, and the undersigned Trustee, having been instructed in writing by the beneficial owner so to do, will offer the hereinafter described real estate for sale at public auction to the highest responsible bidder at the front door of the Courthouse in Romney, Hampshire County, West Virginia, on Friday, December 15, 2017, at 10:00 a.m., which said property is more particularly described as follows:

All those two certain tracts or parcels of real estate, known and designated as Tract Nos. 59 and 60 as shown on that plat of the Subdivision established by C. H. Parsons, known as Parsons Heights, situate on West Virginia State Route No. 28, about one mile North of the Town of Romney, in Romney District, Hampshire County, West Virginia, and which said plat is duly recorded in the County Clerk’s Office of Hampshire County, West Virginia, in Map Book No. l, at Page l5, together with the right to use, with the other lot owners and general public, of the roads and streets shown and set forth upon said plat, as per a dedication thereof made and executed by previous grantors of said streets and ways for public use dated the 8th day of August, l987, and recorded with the aforesaid plat, as part thereof, in the County Clerk’s Office aforesaid, such use, however, being subject to all the rights, reservations, grants and stipulations therein set forth; and subject also to grant to the Potomac Light & Power Company, a corporation, for a right of way for a power line, heretofore made by previous grantors, and now of record in the County Clerk’s Office aforesaid, if said grant applies to, touches or crosses the lots hereby conveyed. Said lots are shown on the Hampshire County Land Books as being Tax Map 19B, parcels 50 and 49, respectively.

And being the same real estate which was conveyed unto Willard E. Bergdoll, III, by deed of Allan L. Lahman and Barbara Lahman, his wife, dated March 5, 2007, and of record in the aforesaid Clerk’s Office in Deed Book No. 462, at Page 745.

The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk’s Office or affecting the subject property.

The Beneficiary and/or the Servicer of the Deeds of Trust and Note reserve the right to submit a bid for the property at sale.

The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

Terms of the sale are 10 percent cash down to be paid on day of sale, and the balance to be paid by certified or cashiers check within 30 days of the date of the sale.
