TRUSTEE’S SALE OF VALUABLE REAL ESTATE

WEDNESDAY, OCTOBER 26, 2016, AT 2:00 P.M.

The herein described real estate of the Samuel R. Hottinger and Regina A. Brown, formerly known as Regina A. Hottinger, shall be sold at public auction on the Courthouse steps in Romney, Hampshire County, West Virginia, on Wednesday, October 26, 2016, at 2:00 p.m.

Said real estate will be sold pursuant to the authority vested in the undersigned, by the provisions of that certain Deed of Trust executed by Samuel R. Hottinger and Regina A. Brown, formerly known as Regina A. Hottinger, unto H. Charles Carl, III, and/or William C. Keaton, Trustees, to secure unto Patton Family Trust, dated September 16, 1999, the beneficial owner of that certain Deed of Trust, dated the 1st day of November, 2010, and of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book 521, at Page 750. Default having occurred relative to the covenants and conditions as set forth in said Deed of Trust, and the undersigned Trustee, having been instructed in writing by the beneficial owner so to do, will offer the hereinafter described real estate for sale at public auction to the highest responsible bidder at the front door of the Courthouse in Romney, Hampshire County, West Virginia, on Wednesday, October 26, 2016, at 2:00 p.m., which said property is more particularly described as follows:

All that certain tract or parcel of real estate known and designated as Tract No. Twenty (20) of Rio Grande Subdivision, containing 5.004 acres, more or less, situate in Sherman District of Hampshire County, West Virginia, on the drains of North River lying on the Northwest side of West Virginia Route No. 11 approximately 1.2 miles northeast of its intersection with West Virginia Route No. 29, together with all roads, rights of way, minerals, easements and appurtenances thereunto belonging, according to a plat of the said Rio Grande Subdivision as prepared by Davy and Lovett Enterprises, Inc., Rickie C. Davy, Registered Land Surveyor, dated September 13, 1977, of record in the Clerk’s Office of the County Court of Hampshire County, West Virginia, in Map Book No. 2, at page 122, and the revision thereof, which is of record in the aforementioned Clerk’s Office in Map Book No. 2, at page 142. Said real estate is depicted on the Hampshire County Land Books as being Tax Map 2 Parcel 44.

And being the same real estate which was conveyed unto Samuel R. Hottinger and Regina A. Hottinger, his wife, by deed of Patton Family Trust, dated November 1, 2010, and which said deed is of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book 492, at page 359.

The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk’s Office or affecting the subject property.

The Beneficiary and/or the Servicer of the Deeds of Trust and Note reserve the right to submit a bid for the property at sale.

The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

Terms of the sale are 10 percent cash down to be paid on day of sale, and the balance to be paid by certified or cashiers check within 30 days of the date of the sale.
