TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated October 6, 2008, executed by Borrower(s), Brandi L. Torres and Kevin L. Torres, to William S. Winfrey, II, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1152, at Page 361. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 419 Wyndale Dr., Princeton, WV 24739. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 28, 2018, of record in the Clerk’s Office in Book 1351, Page 320. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

19th day of April, 2018 at 11:15 a.m.

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Plymouth District, Mercer County, West Virginia, and being more particularly described as follows:
All that certain tract or parcel of real estate, together with the improvements thereon, situate in Plymouth District, Mercer County, West Virginia, designated as Lot 22, on map entitled ‘Plat Showing Corrected Curve Data & Meets and Bounds for Lots 22, 23, 24 & 25 of Wyndale Subdivision, Property of Keesling Construction Company, Plymouth District, Mercer County, Situate 2 Miles Northeast of Princeton, West VA., Scale 1″ = 50′, July 12, 2000, Shields Engineering Company, LLC’, which map is of record in the Mercer County Clerk’s Office as Microfilm Plat No. 14228, and which property is more particularly bounded and described as follows:
Beginning at a point on the western line of Wyndale Drive at the northeastern most corner of Lot 21 and the southwestern most corner of Lot 22 herein described; thence along and with the western line of Wyndale Drive, N. 36′ 22′ 00″ W. 37.11 feet to a point; thence with a curve on a chord of N. 59′ 59′ 46″ W. 24.05 feet (with an arc of 24.75 feet) to a 1/2 inch rebar set thence with a curve having a chord of N. 60′ 08′ 26″ W. 35.62 feet (with an arc of 36.67 feet); thence leaving Wyndale Drive and with the dividing line between Lots 23 and 22, S. 53′ 43′ 55″ W. 240.58 feet to a point; thence S. 72′ 49′ 26″ E. 135.00 feet to a point; thence N. 53′ 38′ 00″ E. 196.49 feet to the place of beginning, and containing 0.47 acres, more or less.”
And being the same property conveyed to Kevin L. Torres and Brandi L. Torres, husband and wife, by David M. Toney, II and Kris A. Toney, husband and wife, by Deed dated September 16, 2008 being of record in Deed Book 930, Page 87 of the records of the Mercer County Clerk.
This conveyance is subject to all pertinent easements, restrictions and reservations of record. The property is subject to the Declaration of Protective Covenants, Reservations and Restrictions Pertaining to Lots in Wyndale Subdivision as recorded in said Clerk’s Office in Deed Book 807, at Page 341, and amended by ‘First Amendment to Declaration of Protective Covenants, Reservations and Restrictions’ dated March 1, 2000, recorded in Deed Book 817, at Page 328, and amended by ‘Second Declaration of Protective Covenants, Reservations and Restrictions’ dated August 26, 2005, recorded in Deed Book 886, at Page 263.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
