NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated October 27, 2015, executed by Borrowers, Sharon Gayle Sheasley and Wayne E Sheasley, to Andrew C. Skinner, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1306, at Page 196. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1704 Whitethorn Street Ext, Bluefield, WV 24701. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 24, 2018, of record in the Clerk’s Office in Book 1356, Page 1. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

20th day of September, 2018 at 11:15 a.m.

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Bluefield District, Mercer County, West Virginia, and being more particularly described as follows:

all of two certain lots or parcels of land in the City of Bluefield, Mercer County, West Virginia, which are shown on the map of the said City as Lot 4, Section 1101 and Lot 6, Section 1101 and which are particularly bounded and described as follows:
“LOT NO. 4, SECTION 1101
“BEGINNING at a point in the north line of Whitethorn Street at a distance of 50 feet westwardly from the intersection of the west line of Golf Street with the said North line of Whitethorn Street the said beginning point being at the southwest corner of Lot 2, Section 1101; thence with the north line of Whitethorn Street S. 54deg. 22′ W. 50 feet to a point at the southeast corner of Lot 6, Section 1101; thence with the east line of Lot 6, N. 35deg. 38′ W. 150 feet to a point at the southwest corner of Lot 3, Section 1101; thence with the south line of Lot No. 3, N. 54deg. 22′ E. 50 feet to a point at the northwest corner of Lot 2, Section 1101; thence with west line of Lot No. 2, S. 35deg. 38′ E. 150 feet to the point of BEGINNING.”

“BEGINNING at a point in the north line of Whitethorn Street at a distance of 100 feet westwardly from the intersection of the west line of Golf Street with the north line of Whitethorn Street, the said beginning point being at the southwest corner of Lot 4, Section 1101; thence with the north line of Whitethorn Street S. 54deg. 22′ W. 50 feet to a point at the southeast corner of Lot 8, Section 1101; thence with the east line of Lot No. 8, Section 1101; thence with the east line of Lot No. 8, N. 35deg. 38′ W. 150 feet to a point at the southwest corner of Lot 5, Section 1101; thence with the south line of Lot No. 5, N. 54deg. 22′ E. 50 feet to a point at the northwest corner of Lot 4, Section 1101; thence with the west line of Lot No. 4, S. 35deg. 38′ E. 150 feet to the point of BEGINNING.”
AND BEING the same real estate conveyed unto the Parties of the First Part herein, by deed dated the 2nd day of October, 2015, from Winnie H. Haynes, Executrix of the estate of Carrie Peery Humphreys, which deed is intended to be recorded simultaneously herewith.
This conveyance is subject to all pertinent easements, restrictions, and reservations of record.

Being the same property conveyed to Sharon Gayle Sheasley and Wayne E Sheasley by the Deed dated October 2, 2015 and recorded in Deed Book 1025 at Page 11 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
