NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated March 28, 2006, executed by Borrowers, Alfred S. Thomas and Juanita M. Thomas, to Philip Hereford, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1073, at Page 208. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 3090 Matoaka Rd, Rock, WV 24747. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 11, 2019, of record in the Clerk’s Office in Book 1368, Page 473. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

10th day of May, 2019
at 11:00 a.m.

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Rock District, Mercer County, West Virginia, and being more particularly described as follows:

“FIRST: ‘BEGINNING at a point in the North right-of-way line of State Highway Route No. 10 at the southeast corner of the property herein described and at the southwest corner of a tract of land conveyed to Roy Lovell by Joe. E. Crotty; thence N. 3deg. 30′ W. with a line of Roy Lovell and Joe E. Crotty 560.6 feet to a maple; thence with Bud C. Huffman, N. 4deg. 24′ W. 225 feet to a stone; thence S. 3deg. 30′ E. 655.11 feet to a point in the North line of said highway right-of-way line; thence with same, S. 66deg. 30′ E. 175 feet to the point of BEGINNING.’
“SECOND: BEGINNING at a stake at the intersection of the North right-of-way of State Route No. 10, with the east line of what is known as the Willie Higgins tract; thence with the said Higgins line, N. 3deg. 20′ W. 115.0 feet to a stone; thence leaving said Higgins’ line, S. 76deg. 15′ E. 50.0 feet to two white oaks standing about eight inches apart; thence S. 1deg. 51′ E. 123.0 feet to the right of way of State Route No. 10; thence with said right-of-way line, N. 66deg. 30′ W. 50 feet to the point of BEGINNING, containing 0.13 acres, more or less.’
“THIRD: ‘BEGINNING at a stake at a rock, maple and oak, in the right-of-way of State Route No. 10 and running with said right-of-way S. 55deg. 39′ E. 507.3 feet to a State Road Marker No. 150+00-45; thence S. 39deg. 31′ E. 206.5 feet to a State Road Marker, S. 35deg. 31′ W. 20.2 feet to State Road Marker No. 148+00-120 and bank of De-Lashmeet Creek; thence up and with said Creek, N. 53deg. 30′ W. 67.7 feet, N. 72deg. 57′ W. 134.2 feet; N. 53deg. 30′ W. 161.2 feet, N. 84deg. 55′ W. 99.4 feet; N. 72deg. 16′ W., 153.5 feet; N. 33deg. 54′ W. 175.9 feet to a stake on the Bank of De-Lashmeet Creek; thence leaving said-Creek and running N. 52deg. 46′ E. 147.5 feet to the point of BEGINNING’, containing 2.53 acres, more or less.”
There is EXCEPTED and RESERVED, a 1.11 acre parcel conveyed by Rema L. Lovell unto Willie Higgins and Aileen Higgins, by deed dated March 11, 1976, recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book 532, at page 758.

Being the same property conveyed to Alfred S. Thomas and Juanita M. Thomas by the Deed dated March 1, 2000 and recorded in Deed Book 817 at Page 391 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
