The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 20, 2007, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Book No. 1116, at Page 419; modified in Document No. 503494, in Book No. 1250, at Page 130; modified in Document No. 578040, in Book No. 1274, at Page 70; and modified in Document No. 682871, in Book No. 1323, at Page 681, Christopher Shawn Mullins and Tara Yvonne Mullins did convey unto William S. Winfrey, II, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated April 13, 2016, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Bayview Loan Servicing, LLC, a Delaware Limited Liability Company, to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on

“All that certain tract or parcel of real estate, together with the improvements thereon and appurtenances thereunto belonging, as shown on ‘PLAT OF SURVEY SHOWING THE SURVEY OF THE TIM JENNINGS PROPERTY BEING THE WESTERN PART OF WHAT IS COMMONLY KNOWN AS THE ROY T. BELCHER PROPERTY AS DESCRIBED IN D.B. 462 Pg. 195, SITUATE ON THE WATERS OF BRUSH FORK CREEK, APPROX. 1 Mi. SOUTH OF THE COMMUNITY OF LITTLESBURG ON CO. RD. #36, BEAVER POND DIST. MERCER CO. WV SCALE 1″=50′, SURVEY 9-95, BY RONALD D. FINK P.S. RT. 9 BOX 71B PRINCETON WV 24740 TAX MAP #18 PARCEL #132, 1,’ said plat recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat No. 12141, and more fully bounded and described as follows:
“BEGINNING at a point on the northern line of a roadway leading to County Route 36 at its intersection with an existing right-of-way, an iron pin being set at said intersection; thence with the fence line along the eastern boundary line of said existing right-of-way, N. 38deg. 22′ 44″ W. 279.34 feet to a corner post; thence along an old fence line, N. 64deg. 39′ 27″ E. 178.91 feet to a corner post found; thence S. 33deg. 29′ 12″ W. 114.10 feet to a corner post; thence with the fence line, S. 19deg. 42′ 34″ E. 140.67 feet to a point on the road leading to County Route 36; thence with the northern line of same, S. 55deg. 25′ 11″ W. 119.80 feet to the place of BEGINNING.”
“This conveyance is subject to and benefitted by all reservations, exceptions, limitations, restrictions, easements, covenants and conditions of record affecting this real estate.”

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 262 Vista Rd, Bluefield, WV 24701.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
