Pill, Esq., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated January 19, 2017, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, NA, to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on

Beginning at a roof bolt at the southeast corner of Lot ‘H’ the northeast corner of Lot ‘G’ and the northwest corner of Lot ‘M’ said bolt also being the southwest corner of Lot L and the herein described tract; thence along the eastern line of Lot ‘H’ N 13 degrees 17′ 56 degrees W 200.00 feet to a roof bolt; thence along the southern line of Lot ‘I’ N 66 degrees 25′ 46 degrees E 168.70 feet to a roof bolt; thence along the southern line of Lot ‘K’ N 55 degrees 02′ 54 degrees E passing a roof bolt on line at 160.00 feet and continuing for a total distance of 175.00 feet to a point in the centerline of a 30 feet right of way; thence along said right of way four calls; S 27 degrees 44′ 15 degrees E124.66 feet to a point at the intersection of two thirty feet right of ways S 23 degrees 29′ 1l’ W 88.75 feet to a point; S 18 degrees 02′ 38 degrees W 107.25 feet to a point, thence S 10 degrees 58′ 01″ W 56.04 feet to a point; thence along the northern line of Lot ‘M’ S 86 degrees 37’17” W passing a roof bolt on line at 15.00 feet and continuing for a total distance of 231.23 feet to the point of beginning and containing 1.84 acres, more or less. There is excepted and reserved from this conveyance a right of way for ingress and egress along the eastern line and an easement for a water line along the eastern line of the property described above and as shown on the above referenced plat of survey,

This conveyance is made subject to the Declaration of Protective Covenants, Restrictions and Reservations of Autumn Oaks Subdivision, together with the easements contained therein, recorded in said Clerk’s Office in Deed Book 873 at page 420.

This conveyance is made expressly subject to all pertinent restrictions, reservations and easements of record.

And being the same property acquired by Federal national Mortgage Association, be Deed dated April 14, 2012, from Golden & Amos, PLLS, Trustee, recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 976 at page 89.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 581 Fall View Rd, Princeton, WV 24740.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
