Ellis, Jr. and Heather Ellis did convey unto Douglas McElwee, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated February 8, 2017, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Quicken Loans Inc. to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Plymouth District, Mercer County, West Virginia, and more particularly described as follows:

A certain tract or parcel of real estate situate on the waters of Christian Fork, approximately S miles East of Princeton, on Pisgah Rd., Co. Rd #24, Plymouth & East River Districts, Mercer Co. WV, (erroneously referred to as WY) which is more particularly bounded and described as follows: Beginning at a 5/8″ rebar with a cap in the northern right-of-way line of Pisgah Rd., Co. Rd. #24, and in the common comer of the Ronald D. Fink property (DB. 884 Pg. 250) and the L.R. Catron property (DB. 548 Pg. 634); thence leaving the common comer of said Catron and running with the northern right-of-way line of said Co. Rd. #24, the following chord bearing and distance: S38deg.38’02″W-54.29′ to a 5/8″ rebar with a cap; thence leaving the northern right-of-way line of said Co. Rd. #24 and running partially through the said Fink property and then through a second tract of the said Fink property (DB. 716 Pg. 777 – Tract#2), the following course and distance N27deg.32’05″W-82.47′ to a 5/8″ rebar with a cap; thence continuing through the second tract of the said Fink property, the following course and distance: S64deg.16’51″W-330.52′ to a 5/8″ rebar with a cap in the eastern right-of-way line of said Co. Rd. #24, said point being situate N15deg.22’30″W-20.33′ from mine roof bolt in the common western corner of the said Fink tracts; thence running with the eastern right-of-way line of said Co. Rd. #24, and running with the southern right-of-way line of said Green Acres Loop, with existing calls, the following two chord bearings and distances: N54deg.03’E -32.96′ to a iron pin N22deg.09’E – 39.94′ to a iron pin in the common corner of the JP Morgan Chase Bank, N.A. property (DB. 940 Pg. 671); thence leaving the southern right-of-way line of said Green Acres Loop, and running with the common line of said JP Morgan Chase Bank, N.A., with existing calls, the following three (3) courses and distances: S71deg.32’E – 126.16′ to a 1/2″ pipe S66deg.29’E – 198.95′ to a 1/2″ pipe N64deg.57’E – 46.55′ to a 1/2″ pipe in the common corner of the Paul M. Cantebtny property (DB. 614 Pg. 302); thence leaving the common comer of said JP Morgan Chase Bank, NA., and running with the common line of said Cantebury, with existing calls, the following course and distance: N82deg.06’E – 94.93′ to a iron pin in the common corner of the Richard Catron property (DB. 713 Pg. 573); thence leaving the common corner of said Catron and running with the common line of said Richard Catron, with existing calls, the following course and distance S27deg.00’E – 114.24′ to a iron pin in the common corner of the Leathern R.R. & Leatha D. Catron properties; thence leaving the common corner of said Richard Catron and running with the common line of said Leathern RR. & Leatha D. Catron, with existing calls, the following course and distance: S62deg.14’W – 150.52′ to a {4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}”galvanized steel pipe; thence continuing with the common line of said Leathern R.R. & Leatha D. Catron, the remaining two (2) courses and distance: S26deg.26’00″E – 214.23′ to a 1/2″ steel pipe S27deg.38’00″E – 38.97′ to the point of beginning, and containing 4.30 acres more or less. There is excepted and reserved from this conveyance an easement for installation and maintenance of service (hookup) or extension lines to any public utilities which may exist in the future on the above described tract, which would include public sewer, etc. This easement is for the benefit of Ronald D. Fink, his heirs or assigns, for the properties described in DB. 884 Pg. 250 (East River District Tax Map #18 – Parcel #47.1) and the property described in D.B. 716 Pg. 777 – Tract #1 (East River District Tax Map #18 – Parcel #47). This conveyance is made subject to any and all easements, conditions, restrictions and covenants now of record in said Clerk’s Office, to the extent that the same may lawfully affect the property herein conveyed and subject to such matters as would be revealed by a careful inspection of the premises.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1721 Pisgah Rd, Princeton, WV 24739-8385.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
