The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 3, 2003, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Book No. 989, at Page 50, Sandra B. Graham did convey unto BB&T Collateral Service Corporation, a WV corporation, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated April 17, 2017, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Branch Banking and Trust Company to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Beaver Pond District, Mercer County, West Virginia, and more particularly described as follows:

“All of that certain parcel of land being a portion of the M. W. Winfrey Estate, and lying on the southerly side of the right of way of the Tri-City Traction Company Street Car Line, about two (2) miles South of the City of Princeton, East River District, Mercer County, West Virginia, and more particularly bounded and described as follows: “BEGINNING at a point in the center line of Brush Creek; thence S. 36deg. 30′ W. 287 feet to a point in the eastern right-of-way line of the Tri-City Traction Company’s line; thence with said eastern right-of-way line S. 55deg.40′ E. 196 feet to a point; thence continuing with said right of way line S. 58deg.05′ E. 170 feet to a Locust Gate-Post on said line of said right-of-way; thence leaving said right-of-way and running N. 39deg.05′ E. and passing between two Willows on the West bank of Brush Creek, a distance of 238 feet to the center of said Creek; thence with said center line of said Creek and down same N. 44deg.30′ W. 190 feet; thence continuing along said center line of said Creek, N. 54deg. 20′ W. 192 feet to the point of BEGINNING.” “All that certain tract or parcel of real estate, together with the improvements thereon, situate on the waters of Brush Creek in Beaver Pond District, Mercer County, West Virginia, approximately one mile south of the City of Princeton, West Virginia, which property is more particularly bounded and described as follows: “A certain tract of land triangular in shape and containing approximately 3.4 acres, more or less, situate on the north side of U. S. Routes 19 and 460 and bounded on the southwest by the waters of Brush Creek; on the northeast by the lands of D. T. Carr, Jr. and on the east by the right-of-way of U. S. Routes 19 and 460 which parcel of real estate is part of the real estate transferred by C. M. and Minnie Winfrey to E. W. Doyle and Virgie Doyle, conveyed by a deed dated January 25, 1943, of record in the afore- said Clerk’s Office in Deed Book 257, at Page 349, and by deed dated March 8, 1937, of record in the aforesaid Clerk’s Office in Deed Book 229 at Page 592, the Grantors herein being the intestate heirs of Virgie Doyle.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 281 Old Bluefield Rd., Princeton, WV 24740.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
