The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated July 27, 2007, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed of Trust 902, at Page 232 and rerecorded in Deed of Trust Book 902, at Page 831, Sean D. Butler and Ashley D. Glasser did convey unto Karen M. Yokum and Susan L. Petrella, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Fairmont City District, Marion County, West Virginia, and more particularly described as follows:
All of that certain lot or parcel of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate in the Fairmont Development Company’s Addition to the City of Fairmont, Fairmont District, Marion County, West Virginia, a map or plat of which Addition is of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 59, at Pages A to E, described as follows:
NORTHERN HALF OF LOT NUMBER TWELVE (12) IN BLOCK NUMBER EIGHTEEN (18), of said Addition, known as 534 Gaston Avenue, described as follows:
Beginning at a point in the eastern line of Gaston Avenue distant thereon 200.00 feet southwardly from the northern line of Fifth Street, said point being a corner to Lot No. 13 of said Addition, thence with the southern line of Lot No. 13, S. 62° 50′ E. 120.0 feet to a point in the western line of a 20 foot alley; thence with the western line of said alley, S. 27° 04′ W. 25.0 feet to a point, corner to the southern half of Lot No. 12; thence with the northern line of said lot No. 12, N. 62° 56′ W. 120.0 feet to a point in the eastern line of Gaston Avenue; thence with the eastern line of Gaston Avenue, N. 27° 04′ W. 25 feet to the place of beginning.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 524 Gaston Avenue, Fairmont, WV 26554.
AND BEING the same real estate which was conveyed to Sean D. Butler and Ashley D. Glasser by Deed dated July 13, 2007, from Domico Funeral Homes, Inc., and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1026, at Page 813.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
