In execution of a Deed of Trust in the original principal amount of $50,999.00, dated April 9, 2013 recorded in the Clerk’s Office of the Circuit Court of the Tazewell County, Virginia, in Document No. 130001226, in Book No. 2013, at Page 06536, default having occurred in the payment of the Note thereby secured and at the request of the holder of said Note, the undersigned Substitute Trustee will offer for sale at public auction at the entrance to the Circuit Court of Tazewell County, 135 Court Street, Tazewell, on May 8, 2018 at 11:00 AM the property described in said deed, located at the above address and briefly described as:

Parcel 1: All that certain property more particularly described therein as follows: ” all of the following described tract or parcel of land situate on Pounding Mill Branch: Beginning at a point in the north right of way line of Virginia Highway Route 637, said point being the southwest corner of Lot 22 as the same is shown, designated and described on the plat with certificate known as “Plat of Subdivision made for G. and R. Hagy”, of record in the Clerk’s Office of Tazewell County, Virginia, thence leaving said highway and with the west line of said Lot 22, N. 21 degrees 08′ 58″ W. to a point in the middle of the creek; thence with the center of said creek as it meanders in an easterly direction to a point in the east line of said Lot 22, thence with the east line of said Lot 22, S. 21 degrees 13′ 08″ E. to a point at the intersection of the southwest line of Lot 21 as shown on said plat with the east line of Lot 22, thence continuing with the east line of Lot 22, S. 20 degrees 42′ 08″ E. 101.50 feet to the north line of Virginia Highway Route 637, thence with said highway S. 64 degrees 09′ 16″ W. 116.61 feet to the point of beginning, and;

Parcel 2: All those two certain lots or parcels of land, together with all easements and appurtenances thereunto belonging, and the improvements situate thereon, located on the waters of Pounding Mill Branch
TRACT 1: Beginning at a point lying in the northern line of Virginia State Route 637, said point lying 1 foot east of a 10 inch locust tree, and also situate N. 58 degrees 48′ E. 120.00 feet from a point lying in the northern line of said Route, which said point is in the common line between T. W. Breedlove and J.H. Charles, thence from said point of Beginning, leaving said State Highway and through the property of J.H. Charles and M. B. Charles the following N. 23 degrees 25′ W. 101.5 feet to an iron pin top of the bank, thence with the top of said bank on a cord of N. 33 degrees 21′ E. 142.8 feet to an iron pin near an 18 inch locust tree, thence S. 23 degrees 25′ E. 168.5 feet to an iron lying in the northern line of Virginia State Route 637, thence with the northern line of said Route and at a distance of 20 feet from the center line thereof, S 61 degrees 12′ W 120.0 feet to a point of beginning, and containing 0.37 acres, and;

TRACT II: Beginning, at a point in the north right of way line of Virginia State Route 637, said point being the southeast corner of the 0.37 acre lot, thence leaving said Virginia State Route 637 and with the east line of said 0.37 acre lot N 23 degrees 25′ W 168.50 feet to a point, thence S. 38 degrees 41′ E. 173.54 feet to a point in the north right of way line of said Virginia State Route 637, thence with the same S. 65deg. 13′ W. 45.73 feet to the point of beginning, containing 0.09 acres, with improvements thereon.

Subject to any and all covenants, conditions, restrictions, easements, and all other matters of record taking priority over the Deed of Trust, if any, affecting the aforesaid property.

TERMS OF SALE: CASH: A deposit of $20,000.00 or 10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} of the sales price, whichever is lower, cash or certified check will be required at the time of sale, but no more than $10,000.00 of cash will be accepted, with settlement within fifteen (15) days from the date of sale. Sale is subject to post sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale which affects the validity of the sale, as well as to post-sale confirmation of the status of the loan with the loan servicer including, but not limited to, determination of whether the borrower entered into any repayment agreement, reinstated or paid off the loan prior to the sale. In any such event, the sale shall be null and void, and the Purchaser’s sole remedy, in law or equity, shall be the return of his deposit without interest. Additional terms may be announced at the time of sale.
