In execution of the Deed of Trust dated January 2, 2014 and recorded on January 7, 2014 in Book 2014 at Page 00161 in Instrument # 140000047 of Tazewell County land records, Trustee Services of Virginia, LLC, the appointed Substitute Trustee, will offer for sale at public auction at the front of the Circuit Court for the County of Tazewell, Main Street, Tazewell, Virginia on October 15, 2018 at 2:00 PM the property more particularly described in the aforementioned Deed of Trust, located at the property address listed below and briefly identified as follows:

All the following described tract or parcel of land situate in Boissevain, in Tazewell County Virginia, known as the “Boissevain Parsonage Property” , and described as follows:

Beginning at the northwest corner of the Baptist Church lot, as shown and designated on that certain plat with certificate by Pocahontas Fuel Company Incorporated, dated August 28,1953 and designated as Boissevain Subdivision No. 2, which plat and certificate are of record in the Clerk’s Office of the Circuit Court of Tazewell County, Virginia in Deed Book 218, page 53, and Plat Book 1, page 68, to which reference is here made, thence with the east right of way line of Virginia Highway 644, N. 28deg. 09′ W. 124.48 feet to a point, thence leaving said Highway through the lands of the party of the first part, N. 59deg. 45′ E 117.62 feet to a point, thence through the lands of the party of the first part, S. 29deg. 15′ E 108.40 feet to a point being the northeast corner of said Baptist Church lot, thence with said Baptist Church lot three courses, S. 69deg. 50′ W. 69.02 feet, S. 27deg. 52′ E 21.15 feet, S. 62deg. 26′ W. 49.02 feet to the Beginning, containing 0.32 acres, more or less, and being a part of that certain lot designated on the aforesaid plat with certificate as ‘DOCTORS OFFICE & RESIDENT.

AND BEING the same real property conveyed to Arnold Walters and Evelyn Walters by deed dated June 27, 1989, and recorded June 27, 1989, in the Office of the Clerk of the Circuit Court of Tazewell County, Virginia, in Deed Book 594, page 471 reference to which is hereby made for a more particular description of the real property hereby conveyed. It is herein noted for the record that Arnold Walters died intestate on July 31, 2013. The said Arnold Walters and Evelyn Walters owned the property as husband and wife, as tenants by the entirety with right of survivorship.

The property will be sold “AS IS,” WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND AND SUBJECT TO conditions, covenants, restrictions, reservations, easements, rights of way, and all other matters of record taking priority over the Deed of Trust, if any, as might be listed in this notice or may be announced at the sale.

TERMS OF SALE: A non-refundable bidder’s deposit of $2,500.00 or 10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} of the sale price, whichever is less, by cashier’s or certified check required at time of sale, except for the party secured by the Deed of Trust. Risk of loss is on the purchaser from date and time of auction. Balance of the purchase price must be paid by cashier’s check within 14 days from sale date. Except for Virginia Grantor tax, all settlement costs and expenses are purchaser’s responsibility. Taxes are pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses, and attorney’s fees of both sales. If Trustee does not convey title for any reason, purchaser’s sole remedy is return of deposit without interest. This sale is subject to post-sale audit of the status of the loan secured by the Deed of Trust including but not limited to determining whether prior to sale a forbearance, repayment, or other agreement was entered into, the loan was reinstated or paid off, or whether the property became subject to an automatic stay under the U.S. Bankruptcy Code prior to the sale; in any such event this sale shall be null and void and purchaser’s sole remedy shall be return of deposit without interest.
