The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 5, 2015, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Document No. 619920, in Book No. 1294, at Page 776, and re-recorded in Document No. 632341, in Book No. 1300, at Page 444, Kathey Lynn Haway and George Haway did convey unto Thomas S. Lilly & Phillip B. Ball & Fidelity National Title, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated December 16, 2019, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by PennyMac Loan Services, LLC, to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Beaver Pond District, Mercer County, West Virginia, and more particularly described as follows:

All that certain lot or parcel fo land in Beaver Pond District of Mercer County, West Virginia, designated as Lot 11, Block 4, Section 1, Oakland Terrace, on a Map bearing the legend, “OAKLAND TERRACE-BLOCK 4-SECTION 1, LOCATED BEAVER POND DISTRICT, MERCER COUNTY, NEAR GLENWOOD PARK, WEST VIRGINIA, PENTREE, INCORPORATED CONSULTING ENGINEERS-SURVEYORS-PHOTOGRAMMISTS-URBAN & REGIONAL PLANNERS, OAK HILL-PRINCETON, WEST VIRGINIA, MAY 1980, SCALE 1″= 50′, of recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Microfilm Plat No. 7715 A & B”, and more particularly bounded and described as follows: “Lot 11: BEGINNING at a point in the East line of Pinewood Circle at the common corner of Lots 10 and 11 as shown upon said Map; thence along and with Pinewood Circle, chord bearing N. 14 deg. 58’35” E. 219.813 feet to a point, the common corner of Lots 11 and 12; thence with the dividing line between Lots 11 and 12; thence with the dividing line between Lots 11 and 12, S. 39 deg. 00′ E. 137.043 feet to a point, the common corner of Lots 11, 12, 15, 16; thence along and with the northern line of Lots 15 and 10, S. 56 deg. 3′ 10″ W. A total distance of 168.685 feet to the point of BEGINNING, containing 0.364 of an acre, more or less.” AND BEING the same property conveyed unto the party of the first part by deed of Shandy Douglas Keaton and Jamie N. Keaton, of even date herewith and which said deed is intended to be recorded simultaneously herewith. “The property is subject to the Amended Declaration of Protective Covenants, Reservations and Restrictions pertaining to Lots in Oakland Terrace, of record in the Officeof the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 602 at page 263 ” “This conveyance is made expressly subject to all pertinent restrictions, reservations, and limitations of record affecting the real estate herein conveyed.”

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 362 Rosemary St, Princeton, WV 24739.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
