NOTICE
PLEASE TAKE NOTICE that pursuant to West Virginia
Code $8-12-5, as amended, and Part Nine, Article 909
entitled Closure and Abandonment, of the Code of the
City of New Martinsville, West Virginia, the New
Martinsville Planning Commission shall consider the
application of the City of New Martinsville to close and
vacate unused, undeveloped and unnamed alleys and
travel ways listed below, in the City of New Martinsville,
Wetzel County, New Martinsville, West Virginia more
specifically described as follows:
Alley situate between Ohio Street and the Ohio River
lying between Lot 80 and Lot 82 in Martins Addition, City
of New Martinsville, designated as “Alley A”
Alley lying between lams Street and Fourth Street,
situate south of Lots 364-365 and North of Lot 366 in
Magnolia District, Wetzel County, West Virginia,
designated as “Alley B
Alley lying north of Lewis Lane situate between
Highland Avenue and James Street, being west of Lot
32 and east of Lot 173 in Steelton, Magnolia District,
Wetzel County, West Virginia, designated as “Alley C”
Alley lying North of Lewis Lane situate between
Highland Avenue and James Street, being West of Lots
50, 52, & 54 and East of Lots 191, 193 & 195 in
Steelton, Magnolia District, Wetzel County,
West Virginia, designated as “Alley D”
Alley lying North of Lewis Lane situate between
Highland Avenue and James Street, being West of Lots
38, 40 & 42 and East of Lots 179, 181 & 183 in Steelton,
Magnolia District, Wetzel County, West Virginia,
designated as “Alley E”
Alley lying North of Lewis Lane situate between
Highland Avenue and James Street, being West of Lots
44, 46, & 48 and East of Lots 185, 187 & 189 in
Steelton, Magnolia District, West Virginia, designated
as “Alley F”
Alley lying North of Lewis Lane situate between
Highland Avenue and James Street being West of Lot
34 and East of Lot 175 in Steelton, Magnolia District,
Wetzel County, West Virginia, designated as “Alley G”
Alley lying North of Lewis Lane situate between
Highland Avenue and James Street, being West of Lot
36 and East of Lot 177 in Steelton, Magnolia District,
Wetzel County, West Virginia, designated as “Alley H”
The New Martinsville Planning Commission will hold a
hearing on the 21st day of March 2022, at 5:30 o’clock
P.M. in Council Chambers located in the
New Martinsville Municipal Building, at which time and
place the Planning Commission shall hear any evidence
relating to the use of and rights or claims in an to the
unused, undeveloped and unnamed alleys and
passageways as specifically described herein above.
You and/or your attorney shall be given an opportunity
to be heard and to make any proper legal defense, after
which Planning Commission shall make its order
pursuant to law, which may include closing and vacating
the aforesaid alleys and passageways or any portions
thereof.
