Taylor and Opal Taylor” The above referenced Parcel One being the same property which was conveyed by John Price, et als., to Samuel W. Taylor and Opal Taylor, as joint tenants with the right of survivorship and not tenants in common by deed dated September 28, 1999 of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 2482, at page 123 and the above referenced Parcel Two being the same property which was conveyed by deed dated January 20, 1979 from Joyce M. Parker, divorced, to Sam W. Taylor and Opal Taylor, as joint tenants with the right of survivorship and not tenants in common, of record in the above referenced Clerk’s Office in Deed Book 1894, at page 679 and the aforesaid Parcel Three being the same parcel as was conveyed by deed dated December 28, 1967 from Laferne E. Huff to Sam W. Taylor and Opal Taylor, as joint tenants with the right of survivorship and not tenants in common, of record in the aforesaid Clerk’s Office in Deed Book 1510, at page 724. Opal Taylor died in Kanawha County, West Virginia on July 5, 2002 and Sam W. Taylor died testate in Kanawha County, West Virginia on December 17, 2008 and by his Last Will and Testament of record in said Clerk’s Office in Will Book 800, at page 969, he devised the above-described properties unto his daughters, Nancy Pfister, Joyce Parker and Judy Farley. Judy Farley subsequently conveyed her interest in the subject properties unto Joyce Parker and Nancy Pfister by deed dated November 2, 2010 of record in the aforesaid Clerk’s Office in Deed Book 2784, at page 480, by deed dated November 2, 2010 of record in the aforesaid Clerk’s Office in Deed Book 2784, at page 478, and by deed dated November 2, 2010 of record in the aforesaid Clerk’s Office in Deed Book 2784, at page 476. The aforesaid parcels further being the same in which a one-half (ONE-HALF) interest was Quit-claimed from Nancy Pfister to Terry England by deed dated January 12, 2011 and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 2784, at page 482, and which was quit-claimed by Terry England to Nancy Pfister by deed dated December 12, 2014 of record in said Clerk’s Office in Deed Book 2895, at page 697. Parcel One above has a street address of 801 Marianna Street, Charleston, West Virginia 25302. Parcel Two above has a street address of 305 Grant Street, Charleston, West Virginia 25302, and Parcel Three above has a street address of 2721 Chesterfield Avenue, Charleston, West Virginia 25304. The aforesaid parcels shall be offered first for sale as one group or lot to the highest bidder and if no acceptable bids are made for all three parcels, then each parcel shall be offered for sale separately to the highest bidder. The aforesaid sale and conveyance of said parcels is subject to any liens of record, liens of the real estate tax, and to covenants and reservations of record. Conveyance by the undersigned Special Commissioner, shall be without Warranty of title and Warranty of suitability or fitness for use, whether expressed or implied. Purchaser shall be responsible for payment of any excise tax imposed upon the transfer and all recording fees of Deeds of Conveyance. Terms of sale shall be: Cash upon approval and confirmation of sale, by Order of the Circuit Court of Kanawha County, West Virginia. The successful bidder at the time of this sale shall be required to deposit with the undersigned Special Commissioner, in cash or collected funds, a sum equal to Ten (10%) percent, of the amount of the bid for each parcel, which sum shall be credited to the payment of the total purchase amount at the time of confirmation of sale by order as aforesaid. Bidder’s deposit shall not be refundable to the bidder except for failure of the Circuit Court of Kanawha County, West Virginia to approve and confirm the sale as aforesaid.
