NOTICE OF HEARING
ZONING BOARD OF
ADJUSTMENT

Notice is hereby given that the following has been appealed from the action of the City Manager in refusing to grant the following zoning permits:

ITEM 1:
Application #10,335 by Veterinary Associates to erect 2 signs, 10′ ¼” x 4′ and 9′ 8 ¾” x 3′ 8 ¾” Sign would be erected on property located at new location on E. Cumberland Rd.

Reason For Refusal:
Section 44-300 – Business and Industrial Districts
(2) Post signs. One post sign will be permitted for each individual business conducted on the premises. Signs shall be stationary, nonflashing, and must be erected with a minimum clearance of ten feet from the surface and a maximum height of 20 feet. All post signs must be constructed clear of public property lines and must not exceed 100 square feet in area per face.

(3) Ground Signs. Ground signs will be allowed in landscaped areas in all business districts. Ground signs can be placed one or more posts. A ground sign may have a face size no larger than five percent of the landscaped area in which it is set, with a maximum size of 25 square feet. The maximum height of a ground sign shall be eight feet.

ITEM 2:
Application # 10,336 by Recovery Point to open a Group Residential Facility. Facility would be located at the former Salvation Army Facility on Highland Avenue. Zoned RMF

Reason for Refusal:
Section 44 – 86 Special
Exception
The Board of Adjustment may authorize as a special exception.

ITEM 3:
Application # 10,337 by Ever Pauley to erect an 8 ft fence. Fence would be erected on property located at 116 Oakhurst Ave.

Reason for Refusal:
Section 44-90 – Accessory uses in residential areas.
(2) A fence or enclosure wall shall not exceed a height of six feet when located along a rear lot line or sideline, behind the set back line.

ITEM 4:
Application # 10,333 by Jimmie Barlow to erect a 4 foot chain link fence in front yard. Fence would be erected on property located at 211 Willow St.

Reason For Refusal:
Section 44-90 – Accessory uses in residential areas.
(1) A fence or enclosure wall shall not exceed a height of 3 feet whenlocated along the front lot line or when located on any side line, from the front lot line to the setback line. All wire fences are prohibited along the front and side lines, except by approval of the zoning board of adjustments.

A public hearing will be held in the Board of Directors Room, the Municipal Complex at 200 Rogers Street, Bluefield, West Virginia on Tuesday, April 5, 2022 at 4:30 pm.
