NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE Pursuant to the authority vested in the undersigned by deed of trust dated the 11th day of January, 2011, signed by Ruth A. Ware, an unmarried woman, to Daniel J. Humphreys, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 3774, at page 227, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 10:00 o’clock a.m. on the 13TH DAY OF APRIL 2022 at the front doors of the Courthouse in Kanawha County in Charleston, West Virginia the following described real estate: Situate in the District of Union, County of Kanawha and State of West Virginia to-wit: PARCEL NO. ONE (1): Beginning at an iron pin located in the northerly right of way of said West Virginia Secondary Route 53/4 at a point which is N. 75 degrees 18′ W 27.04 feet along said road from the southeasterly corner of a 59 acres parcel of land which the property hereby conveyed is a part; thence from said beginning point along the northerly side of said road N. 75 degrees 18′ W. 214.83 feet to an iron pin and N. 72 degrees 28′ W. 99.75 feet to an iron pin; thence leaving said road and running through said 59 acre parcel of land, N. 14 degrees 02′ E. 122.60 feet to an iron pin and N 12 degrees 00′ E. 157.88 feet to an iron pin which is located S. 12 degrees 00′ W. 28.00 feet from an iron pin in the northeasterly exterior line of said 59 acre tract of land; thence parallel with and 20 feet perpendicularly from said exterior line S. 32 degrees 04′ E. 35.74 feet to an iron pin; S. 33 degrees 40′ E. 274.33 feet to an iron pin and S. 34 degrees 00′ E. 122.34 feet to the place of beginning, containing one acre, more or less. Being the same one of parcel of land shown upon a certain plat attached to the deed hereinafter described entitled “Property Map for Larry E. & Connie S. Turley 1.00 Acre Tract part of original C.L. Figgatt 59 acre tract located on Woodrums Lane Union District, Kanawha County, W.Va, Scale: 1″ = 50′, which plat was made by D. L. Wilkinson, Licensed Land Surveyor No. 52, and dated May 29, 1971. PARCEL TWO (2): Beginning at an iron pin located in the northerly right of way line of said West Virginia Secondary Route 53/4 at a point which is the southwesterly corner of a certain 1.00 acre tract now owned by the grantees; thence from said beginning point along the northerly side of said road, N 79 degrees 30′ 15″ W. 95.16 feet to an 18″ white oak; thence leaving said road N. 11 degrees 09′ 12″ E. 391.71 feet to a 1/2″ iron rebar; thence S. 32 degrees 04′ E. 151.36 feet to an old iron pin; thence S. 12 degrees 00′ W. 157.88 feet to an iron pin; thence S. 14 degrees 02” W. 122.60 feet to the place of beginning, containing 0.7799 acres as shown on that certain map entitled Map Showing a 0.7799 Acre Parcel of Land being Part of Original C.L. Figgatt 59 Acre Tract located on Woodrums Lane, Union District, Kanawha County, West Virginia for Ruth Ware and Joan M. Faris made by David E. Thomas, the Office of the Clerk of the County Commission of Kanawha County, West Virginia, Licensed Land Surveyor which said map is recorded in Map Book 51 at page ____. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. The above described real estate is reported to have a mailing address of: 4572 Woodrum Ln, Charleston, WV 25313 To the knowledge of the Trustee, this sale is not in violation of any Coronavirus Pandemic regulations or requirements of any governmental agency. TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees. Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder. Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry.
